PCR2005006 RESOLUTION #P.C.006-2005 APPROVAL OF A BUILDING SITE AND OPERATION PLAN AMENDMENT FOR KEN ZYLKE IN THE SE ¼ OF SECTION 9 (TAX KEY NO. 2196.955 / S75 W17385 JANESVILLE ROAD) WHEREAS, On December 28, 2004 plans were submitted by Ken Zylke for an amendment to a Building, Site and Operation Plan for a property located in the SE ¼ of Section 9 (Tax Key No. 2196.955 / S75 W17385 Janesville Road), and WHEREAS, Said property is zoned B-3 General Business District, and said use is a permitted use by right subject to Building Site and Operation Plan approvals, and WHEREAS, The site currently consists of one structure with retail space on the first floor and an apartment on the second floor, and WHEREAS, The site currently consists of sporadic gravel parking areas with limited landscaping, and WHEREAS, The Petitioner proposes to alter the current site by adding a paved parking lot to meet the required off street parking needs and add additional landscaping, and said proposal meets the bulk requirements of the Zoning Code, and WHEREAS, Parking is illustrated with 6 parking stalls that all meet the 10’x20’ requirement, and WHEREAS, 1 space of parking is needed for every 200 square feet of P.F.A. in customer service establishments and 2 parking spaces are needed for each residential unit, and the parking depicted meets the required number of spaces, and WHEREAS, There will be curbing added along the pavement edge of two sides of the deck and stairs area although curbing will not be added along the rest of the new lot, and WHEREAS, There will be bollards and a beam placed near the rear corner of the building for an additional parking stall, and WHEREAS, There are existing large rocks to protect the front corner of the building, and WHEREAS, No additional lighting is shown on the new plans and any new lighting would need Plan Commission approval, and WHEREAS, No area is designated for refuse/recycling and Plan Commission approval would be needed if an enclosure is sought, and WHEREAS, An existing pole sign is located within the ultimate right-of-way and shall be allowed to stay at this time as long as no changes are made to the sign other than a face plate change, and WHEREAS, Stormwater management may need to occur pending engineering review, and THEREFORE BE IT RESOLVED, That the Plan Commission approves of an amended Building, Site and Operation Plan for the Ken Zylke property located in the SE ¼ of Section 9 (Tax Key No. 2196.955 / S75 W17385 Janesville Road). BE IT FURTHER RESOLVED, That the installation of the asphalt will be allowed to occur in the spring time. BE IT FURTHER RESOLVED, That any areas that will not be asphalted will be landscaped and seeded to eliminate the endless gravel areas. BE IT FURTHER RESOLVED, The need for stormwater management for the current site will be determined by the Engineering Department before any work can be done. BE IT FURTHER RESOLVED, That if an outdoor refuse facility is sought it will need to have locations and building elevations approved by the Planning Department and/or Plan Commission. BE IT FURTHER RESOLVED, That a copy of said plans be kept on file in the Building Department and that all aspect of this plan as they relate to drainage shall be maintained in perpetuity unless otherwise authorized by the Plan Commission. BE IT FURTHER RESOLVED, That failure to comply with the approval contained in this resolution shall result in the imposition of fines of $100 per day, the initiation of legal action, or both.
