PCR2004122AMENDED RESOLUTION #P.C. 122-2004 APPROVAL OF A FINAL PLAT FOR THE BOXHORN RESERVE SUBDIVISION LOCATED IN THE NE ¼ OF SECTION 24 (BOXHORN DRIVE / TAX KEY NO. 2253.999.006) WHEREAS, On November 1, 2004 a final plat was submitted by Creative Homes for Boxhorn Reserve Subdivision located in the NE ¼ of Section 24, and WHEREAS, The plat consists of approximately 20.5 acres, proposes 16 single-family parcels, two outlots, and provides approximately 10.83 acres of open space, and WHEREAS, Said property is zoned R-2 Country Home District, R-3 Country Home District, and RS-3 Suburban Residence District and requires a rezoning to RSE/COPD Suburban Estate District with a Conservation Planned Development Overlay to meet minimum density requirements that were approved as part of the yield plan as per #P.C. Resolution #031-2002, and WHEREAS, Said Final Plat substantially conforms to that of the Plan Commission's previously approved Preliminary Plat, under Resolution #P.C. 136-2003, and WHEREAS, Conservation subdivisions must include 50% of the land as open space and the final plat contains approximately 52.8% open space, and WHEREAS, The 2010 Comprehensive Plan depicts this area for residential development at a density not to exceed 0.79 dwelling units per acre, and the plat illustrates a density of 0.73 dwelling units per acre, and WHEREAS, Said parcels will be serviced by City sewer and water, and WHEREAS, Wetlands exist on the property and have been properly depicted on the Final Plat, and WHEREAS, There are Conservation Plan high acquisition priorities on the plat and they will be dedicated to the City as per Conservation Commission recommendation, and WHEREAS, The plat is required to provide on-site stormwater management as required by Chapter 34, and the construction plans accommodate this, and THEREFORE BE IT RESOLVED, That the Plan Commission approves of a 20.5-acre final plat of Boxhorn Reserve Subdivision by Creative Homes, being located in the NE ¼ of Section 24. BE IT FURTHER RESOLVED, That as part of the technical discrepancies Lots 2 and 16 must show no access along Boxhorn Drive. BE IT FURTHER RESOLVED, That the Plan Commission has found that the petitioners have met items ii, iv, and vi of the conservation standards found in the Municipal Zoning Code to allow three bonus parcels within the Final Plat. BE IT FURTHER RESOLVED, That Street Tree and Landscape Plans shall be approved by the Plan Commission prior to release of Building Permits. BE IT FURTHER RESOLVED, That this approval is subject to Developer’s Agreements and a Letter of Credit being approved by the City’s Finance Committee prior to Council approvals. BE IT FURTHER RESOLVED, That this approval is subject to a rezoning approval to RSE/COPD. BE IT FURTHER RESOLVED, That this approval is subject to resolution of technical discrepancies as identified by the City Planning Department and City Engineers, and payment of all applicable fees in Section 18.14 of the Land Division Ordinance and outstanding assessments if applicable. BE IT FURTHER RESOLVED, That a digital file of this Final Plat shall be submitted to the City in accordance with Common Council Ordinance No. 1118 and Resolution 196-2002. BE IT FURTHER RESOLVED, that boundary lines for lot 10 and lot 11 are redrawn to insure that wetlands are inside Outlot 2.
