PCR2004098RESOLUTION #P.C. 098-2004 APPROVAL OF AN AMENDED BUILDING SITE AND OPERATION PLAN AND A CONDOMINIUM PLAT FOR MULTI-FAMILY RESIDENCES ON THE LINDEMAN PROPERTY LOCATED IN THE SE ¼ OF SECTION 3 (S70 W16211 MARTIN DRIVE / TAX KEY NO. 2169.987.004) WHEREAS, Plans were submitted by Greg Petrauski on March 9, 2004 requesting approval of an amended Building Site and Operation Plan and on October 12, 2004 requesting approval of a condominium plat for multi-family residences on the Lindeman property located in the SE ¼ of Section 3 (S70 W16211 Martin Drive / Tax Key No. 2169.987.004), and WHEREAS, The multi-family condominium project is now known as Lindale Villas, and WHEREAS, A Building Site and Operation Plan was approved for the multi-family units as per PC Resolution #048a-2004 pending the approval of a condominium plat, and WHEREAS, Said plat consists of forty-eight residential units in seven structures, and WHEREAS, Said property is currently zoned RSM/OPD, Multiple Family Residential District as modified by the Planned Development Overlay, and WHEREAS, The 2010 Comprehensive Plan depicts this area for multiple family residential development, and the proposal is consistent with the Plan, and WHEREAS, The property is serviced by City sewer and water. WHEREAS, An amendment to the Building Site and Operation Plan is sought to allow a 16’ x 16’ maintenance structure to be constructed on the southern portion of the property, and WHEREAS, The new maintenance structure will be made of the same materials as the principal structures and be of 50% masonry product. THEREFORE BE IT RESOLVED, That the Plan Commission approves of the condominium plat and an amended building, site, and operation plan submitted by Greg Petrauski for Lindale Villas Condominiums located in the SE ¼ of Section 3, subject to resolution of technical discrepancies as identified by the City Planning Department and City Engineers, and payment of all applicable fees in Section 18.14 of the Land Division Ordinance and outstanding assessments if applicable, and establishment of a Condominium Association. BE IT FURTHER RESOLVED, That this resolution is reliant on any needed subdivider’s agreements between the petitioner and the City and all easements receiving approval.
