PCR2004095RESOLUTION #P.C. 095-2004 APPROVAL OF A THREE (3) LOT CERTIFIED SURVEY MAP FOR THE UCHITIL PROPERTY LOCATED IN THE SW ¼ AND SE ¼ OF SECTION 21 AND NE ¼ OF SECTION 28 (W183 S9348 PARKER DR. / TAX KEY NO. 2243.994.004) WHEREAS, On August 13, 2004 a Certified Survey Map was submitted by Darryl Uchitil for a three (3) lot land division located in the SW ¼ and SE ¼ of Section 21 and the NE ¼ of Section 28, (W183 S9348 Parker Dr. / Tax Key No. 2243.994.004), and WHEREAS, The proposed land division would create three lots with sizes of 261,601 square feet, 362,147 square feet, and 1,873,027 square feet and minimum widths of over 300 feet, and WHEREAS, Said property is zoned A - Agricultural District and SW - Shoreland Wetland District, requiring minimum lot sizes of 120,000 square foot and average minimum widths of 300 feet, and WHEREAS, The 2010 Comprehensive Plan depicts this area as being set aside for rural density residential development, and this proposal is consistent with this goal, and WHEREAS, Said parcels will be serviced by private wells and private sewer, and WHEREAS, Rights of way have been dedicated in accordance with the 2010 Street System Plan, and WHEREAS, A letter has been received stating the DNR’s intent to purchase Outlot 1, which will be for conservation purposes, and WHEREAS, The Outlot will be adjoined to the existing DNR Conservancy lands to the south of the parcel, and WHEREAS, A sketch land division was approved per Resolution #P.C. 029-2004 on March 16, 2004. THEREFORE BE IT RESOLVED, That the Plan Commission approves of a Certified Survey Map submitted by Darryl Uchitil for a three (3) lot land division located in the SW ¼ and SE ¼ of Section 21 and the NE ¼ of Section 28, (W183 S9348 Parker Dr. / Tax Key No. 2243.994.004), subject to resolution of technical discrepancies as identified by the City Planning Department and City Engineers, and payment of all applicable fees in Section 18.14(3) of the Land Division Ordinance and outstanding assessments if applicable. BE IT FURTHER RESOLVED, That Outlot 1 shall be used solely for conservation purposes . BE IT FURTHER RESOLVED, That the average widths at the base setback line of less than the required 80 feet are allowed in order to keep in line with the integrity of the rural density that is proposed in the 2010 Land Use Plan for this area. BE IT FURTHER RESOLVED, That a digital file of this CSM shall be submitted to the City in accordance with Common Council Ordinance No. 1118 and Resolution 196- 2002.
