PCR2004090RESOLUTION #P.C. 090-2004 APPROVAL OF AN ANNUAL REVIEW FOR SCHAEFER SNOWPLOWING AND GRADING LOCATED IN THE NW ¼ OF SECTION 29 (W195 S9775 RACINE AVENUE / TAX KEY NO. 2274.998) WHEREAS, The Plan Commission approved an amended Building, Site, and Operation Plan as per #P.C. Resolution #012-2004 requiring an annual review for the property located at W195 S9775 Racine Avenue / Tax Key No. 2274.998, and WHEREAS, The property is zoned R-1 Country Home District, EA Exclusive Agriculture, and EA/OOS Exclusive Agriculture with an Office and Special Service Overlay District and the existing use is in conformance to all the requirements of said zoning districts, and WHEREAS, A previous approval, as per Resolution #P.C. 155-90, was granted subject to no outside storage of any equipment, LP fuel tanks be located next to the building, and the business be limited to 17 drivers, and WHEREAS, The property has a 252’ x 60’ accessory structure for storage and a 32’ x 40’ temporary accessory structure for salt storage, and WHEREAS, A site visit on August 5, 2004 found that various trucks and equipment were stored in the vicinity of the accessory structures on the property, and WHEREAS, No complaints have been received for the property in 2004, and THEREFORE BE IT RESOLVED, The Plan Commission approves of the annual review for Schaefer Snowplowing and Grading located in the NW ¼ of Section 29 (W195 S9775 Racine Avenue / Tax Key No. 2274.998). BE IT FURTHER RESOLVED, The outdoor storage is reasonably screened from view by berms and brush and if complaints are received in the future, the applicant will receive a letter stating to remove all outdoor storage associated with the business on the site or receive Plan Commission approval for new screening devices. BE IT FURTHER RESOLVED, That previously approved plans are kept on file in an address file in the Building Department and all aspect of this plan shall be maintained in perpetuity unless otherwise authorized by the Plan Commission. BE IT FURTHER RESOLVED, That failure to comply with the approval contained in this resolution shall result in the imposition of fines of $100 per day, the initiation of legal action, or both.
