PCR2004076 RESOLUTION #P.C. 076-2004 APPROVAL OF AN AMENDMENT TO A BUILDING, SITE, AND OPERATION PLAN FOR A COMMERCIAL CENTER LOCATED IN THE NW ¼ OF SECTION 10 (JANESVILLE ROAD / TAX KEY NO. 2198.949) WHEREAS, Plans were submitted on June 14, 2004 by Hank Goetzinger for a commercial building owned by H & C Properties LLC in order to locate new heating and cooling equipment on the property, said property is located on Janesville Road (Tax Key No. 2198.949), and WHEREAS, Said property is currently zoned B-4, Highway Business District, and current uses are permitted by right and by a conditional use grant as received per Resolution # 147-99, and WHEREAS, Four heating and A/C units are proposed to be located on the east half of the building enclosed by a cedar or redwood fence, and WHEREAS, The area in question is currently enclosed by fences and brush on all sides and the addition of the units will not impair neighboring sites, and WHEREAS, The housing of mechanicals is consistent with the Downtown Design Guide that the property resides in. THEREFORE BE IT RESOLVED, That the Plan Commission approves of an amendment to a building, site and operation plan submitted by Hank Goetzinger for a commercial property located on Janesville Road (Tax Key No. 2198.949). BE IT FURTHER RESOLVED, That a copy of said plans be kept on file in the Building Department and that all aspect of this plan shall be maintained in perpetuity unless otherwise authorized by the Plan Commission. BE IT FURTHER RESOLVED, That failure to comply with the approval contained in this resolution shall result in the imposition of fines of $100 per day, the initiation of legal action, or both.
