RECOMMENDATION OF APPROVAL OF A PRELIMINARY PLAT
FOR THE OVERLOOK AT CRYSTAL LAKE SUBDIVISION
LOCATED IN THE SE ¼ OF SECTION 32
(MUSKEGO DAM ROAD / TAX KEY NO. 2288.993)
WHEREAS, On April 30, 2004 a preliminary plat was submitted by Pioneer Engineering for The
Overlook at Crystal Lake Subdivision located in the SE ¼ of Section 32, and
WHEREAS, Said plat proposes 8 single-family lots ranging from approximately 56,000 square feet to
73,000 square feet and two (2) outlots for wetlands protection purposes and lake access, and
WHEREAS, Said property is zoned RS-2 Suburban Residence District, which require a minimum lot
size of 40,000 square feet and minimum width of 220 feet for unsewered lots, and said lots meet these
zoning requirements, and
WHEREAS, The Plan Commission has found that the plat is consistent with the adopted 2010 Plan,
the Conservation Plan, the adopted 2003-2007 Park and Open Space Plan, and the 2010 Street System
Plan, and
WHEREAS, Said parcels will be serviced by private sewer and water, and
WHEREAS, Stormwater management will be accommodated on-site and determined at the time of
Final Plat.
THEREFORE BE IT RESOLVED, That the Plan Commission recommends, approval to the Common
Council of an 8 lot Preliminary Plat for The Overlook at Crystal Lake Subdivision, located in the SE
¼ of Section 32 and will be receptive to the submittal of a final plat, subject to resolution of technical
discrepancies as identified by the City Planning Department and City Engineers, and payment of all
applicable fees in Section 18.14 of the Land Division Ordinance and outstanding assessments if
applicable.
BE IT FURTHER RESOLVED, That stormwater management determinations must be made before
the time of Final Plat.
BE IT FURTHER RESOLVED, That Plan Commission approves of the 60 foot public access to
Crystal Lake, opposed to the 100-foot, as it preserves the intent of the ordinance and will not cause
detriment.
BE IT FURTHER RESOLVED, That a digital file of this Plat shall be submitted to the City in
accordance with Common Council Ordinance No. 1118 and Resolution 196-2002.
