PCR2004060RESOLUTION #P.C. 060-2004 RECOMMENDATION OF APPROVAL OF A FINAL PLAT FOR THE KENWOOD PLACE SUBDIVISION LOCATED IN THE SE ¼ OF SECTION 5 (TAX KEY NOS. 2180.979 AND 2180.979.002) WHEREAS, On April 23, 2004 a final plat was submitted by Pegarl LLP for Kenwood Place located in the SE ¼ of Section 5, and WHEREAS, Said plat proposes 37 single-family lots ranging from 14,394 square feet to 167,782 square feet and one (1) outlot for stormwater retention purposes, and WHEREAS, Said property was rezoned as per Council Ordinance #1160 to RS-3/OPD Suburban Residence District with a Planned Development Overlay District and all parcels meet the requirements of this zoning, and WHEREAS, Said Final Plat substantially conforms to that of the Plan Commission's previously approved Preliminary Plat, under Resolution #P.C. 166-2003, and WHEREAS, The Plan Commission has found that the plat is consistent with the adopted 2010 Plan, the Conservation Plan, the adopted 2003-2007 Park and Open Space Plan, and the 2010 Street System Plan, and WHEREAS, Said parcels will be serviced by City sewer, and WHEREAS, Construction plans need approval from the Public Utilities Committee to determine whether to serve the parcel with municipal water or permit a community well and water trust before final Council approvals, and WHEREAS, Outlot 1 will accommodate stormwater management. THEREFORE BE IT RESOLVED, That the Plan Commission recommends approval to the Common Council of a 38 lot Final Plat for the Kenwood Place Subdivision located in the SE ¼ of Section 5. BE IT FURTHER RESOLVED, That Street Tree and Landscape Plans shall be approved by the Plan Commission prior to release of Building Permits. BE IT FURTHER RESOLVED, That this approval is subject to the resolution of water service that will be rectified by the Public Utilities Committee upon approval of construction plans. BE IT FURTHER RESOLVED, That this approval is subject to Developer’s Agreements and a Letter of Credit being approved by the City’s Finance Committee prior to Council approvals. BE IT FURTHER RESOLVED, That this approval is subject to resolution of technical discrepancies as identified by the City Planning Department and City Engineers, and payment of all applicable fees in Section 18.14 of the Land Division Ordinance and outstanding assessments if applicable. BE IT FURTHER RESOLVED, That a digital file of this Final Plat shall be submitted to the City in accordance with Common Council Ordinance No. 1118 and Resolution 196-2002.
