PCR2004052RESOLUTION #P.C. 052-2004 RECOMMENDATION TO COUNCIL TO REZONE THE ST. ANDREW’S VILLAGE PROPERTY FROM THE R-3 COUNTRY HOME DISTRICT AND THE A – AGRICULTURE DISTRICT TO THE RSA/OPD ATTACHED SINGLE FAMILY RESIDENCE DISTRICT WITH A PLANNED DEVLOPMENT OVERLAY DISTRICT LOCATED IN THE NE ¼ AND NE ¼ OF SECTION 25 (TAX KEY NOS. 2258.995 AND 2261.978.001/ RYAN ROAD) WHEREAS, On March 31, 2004 a petition for rezoning was submitted by Rich Kinter to rezone a property for St. Andrew’s Village Condominiums from the R-3 Country Home District and A – Agriculture District to RSA/OPD Single Family Attached District with a Planned Development Overlay District, and WHEREAS, A Public Hearing for the rezoning has been scheduled before the Common Council on May 11, 2004, and WHEREAS, The petition would permit sewered residential development for two-family attached structures on lots with various areas and widths, and WHEREAS, The Plan Commission has previously approved a conceptual rezoning by Resolution #P.C. 091-2003, and this proposal conforms to the conceptual approval, and WHEREAS, The 2010 Comprehensive Plan depicts the property for medium density attached single-family development consistent with the RSA Single Family Attached District, and the addition of OPD Planned Development District zoning permits design flexibility to preserve much of the wetlands and other environmental areas present on the parcels, and WHEREAS, The adopted Conservation Plan depicts medium management areas, and the inclusion of OPD zoning permits design flexibility to preserve said areas. THEREFORE BE IT RESOLVED, That the Plan Commission does hereby recommend approval to the Common Council for the rezoning from the R-3 Country Home District and A – Agriculture District to RSA/OPD Single Family Attached District with a Planned Development Overlay District for the St. Andrew’s Village development within Tax Key Numbers 2258.995 and 2261.978.001.
