APPROVAL OF A TWO (2) LOT LAND DIVISION FOR THE PROPERTY
LOCATED IN THE NW ¼ OF SECTION 13
(TAX KEY NO. 2211.057 / Holz Drive)
WHEREAS, On February 23, 2004 a sketch was submitted by Scott Hennessey
for a two (2) lot sketch land division of the property located in the NW ¼ of
Section 13, (Tax Key No. 2211.057), and
WHEREAS, The proposed land division would create two residential lots with an
average area of 43,246 square feet, and
WHEREAS, Said property is zoned RSE Suburban Estate Residence District
requiring minimum lot size of 40,000 square feet and an average minimum width
of 150 feet and parcels meet said minimum zoning requirements, and
WHEREAS, The 2010 Comprehensive Plan depicts this area as being set aside
for low density residential development and this proposal is within this goal, and
WHEREAS, Only approximately 29 feet of frontage is depicted for parcel 2 at the
base setback line, and
WHEREAS, High management Priorities as identified by the City’s Conservation
Plan are found in the area and all environmental lands have been delineated,
and
WHEREAS, Said parcels will be serviced by public sewer and private water
facilities.
THEREFORE BE IT RESOLVED, That the Plan Commission approve of a sketch
land division being submitted creating a two (2) lot land division of the property in
the NW ¼ of Section 13, (Tax Key No. 2211.057).
BE IT FURTHER RESOLVED, That the average widths at the base setback line
shall have to be re drawn to show equal frontage widths along Holz Drive.
BE IT FURTHER RESOLVED, That a note should be on the final CSM stating
that parcels cannot be divided in the future.
BE IT FURTHER RESOLVED, That this approval is granted in concept only and
final action is only an indication of the current intent of the Plan Commission;
Final submittals are subject to future review and consideration by the Plan
Commission, municipal committees of jurisdiction, and other agencies, and
approval of final plans is not guaranteed by this action of the Plan Commission.
