PCR2004029RESOLUTION #P.C. 029-2004 APPROVAL OF A THREE (3) LOT LAND DIVISION FOR THE PROPERTY LOCATED IN THE SW ¼ AND SE ¼ OF SECTION 21 AND NE ¼ OF SECTION 28 (TAX KEY NO. 2243.994.004 / Parker Drive) WHEREAS, On February 19, 2004 a sketch was submitted by Darryl Uchitil for a three (3) lot sketch land division of the property located in the SW ¼ and SE ¼ of Section 21 and NE ¼ of Section 28, (Tax Key No. 2243.994.004), and WHEREAS, The proposed land division would create two residential lots with an average area of 311,874 square feet, and one outlot, and WHEREAS, Said property is zoned A Agricultural District requiring minimum lot size of 30,000 square feet and an average minimum width of 120 feet and EA Exclusive Agricultural requiring minimum lot size of 35 Acres and an average minimum width of 1,275 feet, and parcels meet said minimum zoning requirements, and WHEREAS, The 2010 Comprehensive Plan depicts this area as being set aside for rural density residential development and this proposal is within this goal, and WHEREAS, Only approximately 60 feet of frontage is depicted per parcel at the base setback line, and WHEREAS, Outlot 3 is intended to be adjoined to the existing DNR lands to the south for future DNR Conservancy, WHEREAS, Said parcels will be serviced by private sewer and water facilities. THEREFORE BE IT RESOLVED, That the Plan Commission approve of a sketch land division being submitted creating a three (3) lot land division of the property in the SW ¼ and SE ¼ of Section 21 and NE ¼ of Section 28, (Tax Key No. 2243.994.004). BE IT FURTHER RESOLVED, That the petitioner continues to bring Outlot 3 under the control of the DNR for DNR Conservancy lands and that those proceedings are made aware to City Staff on a monthly basis. BE IT FURTHER RESOLVED, That the average widths at the base setback line of less than the required 80 feet are allowed in order to keep in line with the integrity of the rural density that is proposed in the 2010 Land Use Plan for this area. BE IT FURTHER RESOLVED, That the final CSM should address that any future land division for these lands shall require the platting of right-of-way for access purposes. BE IT FURTHER RESOLVED, That this approval is granted in concept only and final action is only an indication of the current intent of the Plan Commission; Final submittals are subject to future review and consideration by the Plan Commission, municipal committees of jurisdiction, and other agencies, and approval of final plans is not guaranteed by this action of the Plan Commission.
