APPROVAL OF AN AMEDMENT TO A BUILDING SITE AND OPERATION PLAN FOR
ONYX EMERALD PARK LANDFILL, LLC IN THE NE ¼ OF SECTION 36 (TAX KEY NO.
2301.998)
WHEREAS, On February 12, 2004 plans were submitted by Onyx Emerald Park Landfill,
LLC (Tax Key No. 2301.998 / USH 45) for an amendment to a Building, Site and
Operation Plan for said landfill, located in the NE ¼ of Section 36, and
WHEREAS, Said property is currently zoned I-2 General District, and said use is a
permitted use by right subject to Building Site and Operation Plan approvals, and
WHEREAS, Petitioner proposes to construct 4 modular engine generators and up to six
more in the future all of which will be enclosed in fencing, and said building meets the bulk
requirements of the Zoning Code, and
WHEREAS, The proposal consists of two permanent structures being a control room and
a storage room, and
WHEREAS, Access is provided by existing driveways on the site, and
WHEREAS, Traffic generation will entail two additional vehicles per day on the site, and
WHEREAS, Two employees will be utilized as part of the operation and sanitary facilities
are provided next to the proposal, and
WHEREAS, Stormwater management will utilize the existing swale and sedimentation
basin adjoining the proposal and this basin is enough to support the facility, and
WHEREAS, Photometric Plans have been provided, and said plans meet City
requirements, and
WHEREAS, Said parcels will be serviced by municipal sanitary sewer and private water
services, and
THEREFORE BE IT RESOLVED, That the Plan Commission approves of an amended
Building, Site and Operation Plan for Onyx Emerald Park Landfill, LLC, located in the NE
¼ of Section 36 (Tax Key No. 2301.998 / USH 45).
BE IT FURTHER RESOLVED, That a copy of said plans be kept on file in the Building
Department and that all aspect of this plan as they relate to drainage shall be maintained
in perpetuity unless otherwise authorized by the Plan Commission.
BE IT FURTHER RESOLVED, That failure to comply with the approval contained in this
resolution shall result in the imposition of fines of $100 per day, the initiation of legal
action, or both.
