APPROVAL OF AN ANNUAL REVIEW FOR THE CONDITIONAL USE FOR A SALES AND
SERVICE ESTABLISHMENT FOR AUTOMOBILES, MORE SPECIFICALLY THE PARKING OF
RENTAL VEHICLES, FOR ERDMANN MOTORS AT THE PROPERTY LOCATED IN THE NE ¼
OF SECTION 25
WHEREAS, The Plan Commission approved a Conditional Use Grant for the parking of rental
vehicles on a vacant property on the southeast corner of Loomis Road and North Cape Road
(USH 45) across from Erdmann Motors on March 21, 2000, and
WHEREAS, The property is zoned B-4, Highway Business, and also has a conditional use for the
service of automobiles and the sales of vehicles on the southeast corner of the intersection, and
WHEREAS, Approved plans permit a maximum of ten (10) rental units to be parked at the site on
the northwest corner of the intersection with an annual review of the property's status, and
WHEREAS, The annual review has determined the property to be non-compliant due to rental
vehicles located in the southeast intersection of Loomis and Hwy 45 and not in the approved
northwest intersection location.
THEREFORE BE IT RESOLVED, The Plan Commission approves of the petitioner's annual
review for Erdmann Motors, subject to compliance with all Conditional Use Grant approvals.
BE IT FURTHER RESOLVED, That previously approved plans are kept on file in an address file
in the Building Department and all aspect of this plan shall be maintained in perpetuity unless
otherwise authorized by the Plan Commission.
BE IT FURTHER RESOLVED, That all rental vehicles are to be moved to the approved location
at the northwest intersection of Loomis Road and Hwy 45, and if excess rental vehicles
accumulate they will be located temporarily in the back portion of the lot on the southeast
intersection of Loomis Road and Hwy 45.
BE IT FURTHER RESOLVED, That failure to comply with the approval contained in this
resolution shall result in the imposition of fines of $100 per day, the initiation of legal action, or
both.
