PCR2004009RESOLUTION #P.C. 009-2004 APPROVAL OF A YIELD PLAN AND SKETCH CONSERVATION SUBDIVISION FOR THE SCHMITT PROPERTY, LOCATED IN THE SE ¼ OF SECTION 18 (TAX KEY NOS. 2232.980 AND 2232.981) WHEREAS, On February 17, 2004, a Yield Plan and sketch Conservation Subdivision was submitted by Gayle Schmitt for a subdivision known as Heather’s Way located in the SE ¼ of Section 18, and WHEREAS, The Yield Plan consists of approximately 30 acres, proposes 10 residential parcels, and does not provide for a common stormwater management area, and WHEREAS, The sketch Conservation Subdivision consists of approximately 30 acres, and proposes 14 residential parcels, and provides for common stormwater management outlots and open spaces totaling approximately 50.11% of the land area, and the COPD regulations would permit 3 “bonus” parcels by right subject to meeting certain code provisions, and require a minimum of 50% open space, and WHEREAS, Said property is zoned A Agricultural District, and a rezoning to RCE / COPD would be required in order to implement the sketch preliminary plat, and WHEREAS, The 2010 Comprehensive Plan depicts this area for agriculture and open lands at a density not to exceed .4 dwelling units per acre, and the Yield Plan illustrates a maximum density of 0.33 dwelling units per acre and sketch Conservation Subdivision illustrates a maximum density of 0.46 dwelling units per acre, and WHEREAS, Said parcels will be serviced by private sewer and public water service, and WHEREAS, The 2010 Street System Plan depicts Hillendale Drive to have an 80 foot wide ultimate width, and the proposal appears to be consistent with the Plan, and WHEREAS, wetlands and woodlands exist on the property and are depicted on the sketch Conservation Subdivision to be preserved as common open space, and the Conservation Plan depicts a portion of these wetlands and woodlands as a high acquisition priority, and WHEREAS, The plat is required to provide on-site stormwater management as required by Chapter 34, and the sketch Conservation Subdivision accommodates this requirement. THEREFORE BE IT RESOLVED, That the Plan Commission approves of a yield plan and sketch Conservation Subdivision for the Schmitt property for a subdivision known as Heather’s Way located in the SE ¼ of Section 18 and will be receptive to the submittal of a preliminary plat of the Conservation Subdivision. BE IT FURTHER RESOLVED, That preliminary plat submittal should accompany an updated yield plan that conforms to the A Agricultural zoning district and makes arrangements for stormwater management. BE IT FURTHER RESOLVED, That a maximum 3 bonus residential parcels are permitted subject to Plan Commission and Common Council findings that the Final Plat meets the requirements for the receipt of said bonus parcels. BE IT FURTHER RESOLVED, That the Conservation Subdivision shall have a minimum of 50% open space in outlots to be owned and maintained by an incorporated owners association, and petitioner shall provide area calculations concurrent with Preliminary Plat submittal. BE IT FURTHER RESOLVED, That the Plan Commission will be receptive to the receipt of a rezoning petition to RCE / COPD Suburban Estate District with Conservation Planned Development Overlay District, being a recommended maximum residential parcel size of 60,000 square feet and a recommended maximum average parcel width of 150 feet. BE IT FURTHER RESOLVED, That the Conservation Commission shall address the need for any outlots at the time of preliminary plat. BE IT FURTHER RESOLVED, That the common open space areas shall be subject to a Management Plan which shall be executed concurrent with the Final Plat.
