PCR2004008RESOLUTION #P.C. 008-2004 RECOMMENDATION OF APPROVAL TO REZONE THE SCHMITT PROPERTY FROM A – AGRICULTURE DISTRICT TO THE RCE/COPD COUNTRY ESTATE DISTRICT WITH A CONSERVATION PLANNED DEVELOPMENT OVERLAY LOCATED IN THE SE ¼ OF SECTION 18 (TAX KEY Nos. 2232.980 AND 2232.981/ HILLENDALE DRIVE) WHEREAS, On February 17, 2004 a petition for rezoning was submitted by Gayle Schmitt to rezone the Schmitt property from A – Agriculture District to the RCE/COPD Country Estate District with a Conservation Planned Development Overlay, and WHEREAS, A Public Hearing for the rezoning has been scheduled before the Common Council on March 9, 2004, and WHEREAS, The petition would permit unsewered residential development on lots of a maximum 60,000 square feet in area and 150 feet of width in order to promote conservation based development, and WHEREAS, The 2010 Comprehensive Plan depicts the property for rural and agricultural use consistent with the A – Agriculture District or RCE Residential Country Estate District, and this proposal is consistent with this goal, and THEREFORE BE IT RESOLVED, That the Plan Commission does hereby recommend approval to the Common Council for the rezoning of the Schmitt property identified by Tax Key Numbers 2232.980 and 2232.981 from A – Agriculture District to the RCE/COPD Country Estate District with a Conservation Planned Development Overlay.
