PCR2004007RESOLUTION #P.C. 007-2004 RECOMMENDATION OF APPROVAL TO REZONE THE BOWMIL PROPERTY FROM A – AGRICULTURE DISTRICT TO THE R-3 COUNTRY HOME DISTRICT AND A 2010 PLAN AMENDMENT FROM AGRICULTURE AND OPEN LANDS TO LOW DENSITY RESIDENTIAL LOCATED IN THE NW ¼ OF SECTION 35 (TAX KEY NO. 2298.981.001/ LOOMIS DRIVE) WHEREAS, On January 26, 2004 a petition for rezoning was submitted by Stephen Bowmil to rezone the Bowmil property from A – Agriculture District to the R-3 Country Home District, and WHEREAS, A Public Hearing for the rezoning has been scheduled before the Common Council on February 24, 2004, and WHEREAS, The petition would permit unsewered residential development on lots of 40,000 square feet in area and 150 feet of average width, and WHEREAS, The 2010 Comprehensive Plan depicts the property for rural and agricultural use consistent with the A – Agriculture District or RCE Residential Country Estate District, and the proposal is for a 2010 Plan Amendment from Agriculture and Open Lands to Low Density Residential, which conflicts with the above goal, and WHEREAS, Parcels of the proposed conforming sizes exist in close proximity parcel, and WHEREAS, The Common Council and Plan Commission have directed planning staff to develop a new Zoning Code, and unsewered residential development utilizing R-3 zoning standards is inconsistent with the DRAFT Chapter 40 Zoning Code, and implementation of the rezoning petition would result in non-conforming parcels upon adoption of Chapter 40. THEREFORE BE IT RESOLVED, That the Plan Commission does hereby recommend approval to the Common Council for the rezoning from A – Agriculture District to R-3 Country Home District and a 2010 Plan Amendment from Agriculture and Open Lands to Low Density Residential consistent with the RSE and R-3 zoning districts for the Bowmil property identified by Tax Key Number 2298.981.001.
