PCR2003166RESOLUTION #P.C. 166-2003 RECOMMENDATION OF APPROVAL OF A PRELIMINARY PLAT FOR THE KENWOOD PLACE SUBDIVISION AND THE REZONING FROM RS-2 SUBURBAN RESIDENCE DISTRICT AND RS-3/OED SUBURBAN RESIDENCE DISTRICT WITH AN EXISTING DEVELOPMENT OVERLAY DISTRICT TO RS-3/OPD SUBURBAN RESIDENCE DISTRICT WITH A PLANNED DEVELOPMENT OVERLAY DISTRICT LOCATED IN THE SE ¼ OF SECTION 5 (TAX KEY NOS. 2180.979 AND 2180.979.002) WHEREAS, On January 23, 2004 a preliminary plat was submitted by Pegarl LLP for Kenwood Place located in the SE ¼ of Section 5, and WHEREAS, Said plat proposes 37 single-family lots ranging from 15,007 square feet to 167,422 square feet and two (2) outlots for stormwater retention and a community well, and WHEREAS, Said property is zoned RS-2 Suburban Residence District which requires a minimum lot size of 20,000 square feet and minimum width of 110 feet and RS-3/OED Suburban Residence District with an Existing Development Overlay District requiring a minimum lot size of 11,250 square feet and minimum width of 75 feet, said lots will require zoning amendments to RS-3/OPD Suburban Residence District with a Planned Development Overlay District, and WHEREAS, The Plan Commission has found that the plat is consistent with the adopted 2010 Plan, the Conservation Plan, the adopted 2003-2007 Park and Open Space Plan, and the 2010 Street System Plan, and WHEREAS, Said parcels will be serviced by City sewer, and WHEREAS, The Public Utilities Committee will be required to determine whether to serve the parcel with municipal water or permit a community well and water trust, and WHEREAS, Outlot 1 will accommodate stormwater management. THEREFORE BE IT RESOLVED, That the Plan Commission recommends, approval to the Common Council of a 39 lot Preliminary Plat for the Kenwood Place Subdivision and a recommendation to rezone the lands from RS-2 Suburban Residence District and RS-3/OED Suburban Residence District with an Existing Development Overlay District to RS-3/OPD Suburban Residence District with a Planned Development Overlay District, located in the SE 1/4 of Section 5 and will be receptive to the submittal of a final plat, subject to resolution of technical discrepancies as identified by the City Planning Department and City Engineers, and payment of all applicable fees in Section 18.14 of the Land Division Ordinance and outstanding assessments if applicable. BE IT FURTHER RESOLVED, That a digital file of this Plat shall be submitted to the City in accordance with Common Council Ordinance No. 1118 and Resolution 196-2002.
