APPROVAL OF A CERTIFIED SURVEY MAP FOR THE HEINRICH PROPERTY
LOCATED IN THE NE ¼ OF SECTION 33
(S106 W17518 MUSKEGO DAM ROAD / PART OF TAX KEY NO. 2289.997)
WHEREAS, On November 25, 2003 a Certified Survey Map was submitted by Greg Heinrich for
a 5.72 acre, one (1) lot land division located in the NE ¼ of Section 33, and
WHEREAS, Said lands are located within the Wisconsin DNR Big Muskego Lake Wildlife Area,
and the purpose of said CSM is to permit the conveyance of approximately 33 acres of remnant
land to the Wisconsin DNR, and
WHEREAS, Said property is zoned EA Exclusive Agriculture District, requiring a minimum lot
size of 40,000 square feet and an average minimum width of 150 feet for the division of existing
residences from agricultural lands, and
WHEREAS, The land division ordinance requires all remnant lands to be included on the CSM
except where such remnants are in excess on twenty (20) acres, an exception may be granted by
the Plan Commission, and
WHEREAS, The 2010 Comprehensive Plan depicts this area as being set aside for agriculture
and low density development, and this proposal is consistent with this goal, and
WHEREAS, Said parcels will be serviced by private sanitary sewerage facilities and private
water supply, and
WHEREAS, Rights of way have been dedicated in accordance with the 2010 Street System Plan.
THEREFORE BE IT RESOLVED, That the Plan Commission approves of a Certified Survey
Map being submitted for the Heinrich property located in the NE ¼ of Section 33, subject to
resolution of technical discrepancies as identified by the City Planning Department and City
Engineers, and payment of all applicable fees in Section 18.14(3) of the Land Division Ordinance
and outstanding assessments if applicable.
BE IT FURTHER RESOLVED, That the requirement to include remnant lands on the CSM is
waived.
BE IT FURTHER RESOLVED, That a digital file of this CSM shall be submitted to the City in
accordance with Common Council Ordinance No. 1118 and Resolution 196-2002.
