PCR2003150Planning Department Memo To : Memo to file for Tax Key No. 2192.978.007 From: Jeff Muenkel CC: Mayor Slocomb Date: October 18, 2004 Re: Non-substantial Change to PC Resolution # 150-2003 (Fountain Park Condos) Overlook Bay Apartments petitioned a condominium plat for one of the eight unit structures that existed in the development in 2003. The matter went to the Plan Commission and received full approvals. The condominium plat has since been approved and recorded. Recently it was found that the PC Resolution#150-2003 referenced a different building number than the one that recorded the new condo plat. The building number should have referenced “Building 7” and not “Building 5.” This memo is to serve as notice that the mistake on the Resolution does not substantially affect the original approval and will not need new approvals. The resolution does reference the correct Tax-Key number and that will suffice. This memo should be scanned with the original resolution and kept with the condo approval file as documentation for future reference. RESOLUTION #P.C. 150-2003 APPROVAL OF A CONDOMINIUM PLAT FOR FOUNTAIN PARK CONDOMINIUMS F/K/A BUILDING 5 OF OVERLOOK BAY APARTMENTS, A CONDOMINIUM LOCATED IN THE SE ¼ of Section 8 and NE ¼ Section 17 (TAX KEY NO 2192.978.007) WHEREAS, On October 29, 2003 a condominium plat was submitted by GeoSelect Properties LLC for the Fountain Park Condominiums, located in the SE ¼ Section 8 and the NE ¼ Section 17, and WHEREAS, Said plat consists of eight residential units in one structure, and WHEREAS, Said property is currently zoned RSM/OPD, Multiple Family Residential District as modified by the Planned Development Overlay, and WHEREAS, A Building Site and Operation Plan was previously approved by the Plan Commission, and WHEREAS, The 2010 Comprehensive Plan depicts this area for multiple family residential development, and the proposal is consistent with the Plan, and WHEREAS, The property is serviced by City sewer and water. THEREFORE BE IT RESOLVED, That the Plan Commission approves of the condominium plat submitted by GeoSelect Properties LLC for the Fountain Park Condominiums property located in the SE ¼ of Section 8 and NE ¼ Section 17, subject to resolution of technical discrepancies as identified by the City Planning Department and City Engineers, and payment of all applicable fees in Section 18.14 of the Land Division Ordinance and outstanding assessments if applicable, and establishment of a Condominium Association.
