PCR2003116AMENDED RESOLUTION #P.C. 116-2003 APPROVAL OF A PRELIMINARY PLAT FOR THE WEATHERWOOD COURTS SUBDIVISION, LOCATED IN THE NE 1/4 OF SECTION 25 (TAX KEY NO. 2257.999) WHEREAS, On August 22, 2003 a Preliminary Plat was submitted by Robert Stack for Weatherwood Courts located in the NE 1/4 of Section 25, and WHEREAS, Said plat consist of 11.216 acres, and proposes 20 lots, ranging from 15,070 square feet to 30,615 square feet in size, and WHEREAS, Said property is zoned RS-3 Suburban Residence District, requiring a minimum lot size of 15,000 square feet and an average minimum width of 100 feet, and said lots appear to meet said minimum zoning requirements, and WHEREAS, The 2010 Comprehensive Plan depicts this area for medium density residential development, and this proposal is consistent with the Plan, and WHEREAS, The adopted Conservation Plan does not depict any acquisition or management areas within the plat, and WHEREAS, The adopted 2003-2007 Park and Open Space Plan does not depict any acquisition areas within the plat, and WHEREAS, The Ryan Road and North Cape Road have been previously dedicated to their ultimate widths as depicted on the 2010 Street System Plan, and WHEREAS, Said parcels will be serviced by sanitary sewer, and WHEREAS, Said parcels will access water either through municipal water mains or through individual private wells, and WHEREAS, Access to Ryan Road and North Cape Road is restricted, and WHEREAS, A digital file of this Preliminary Plat has been received in accordance with Common Council Ordinance No. 1118 and Resolution 196-2002. THEREFORE BE IT RESOLVED, That the Plan Commission recommends approval to the Common Council of a 11.216 acre, 20 lot, Preliminary Plat for the Weatherwood Courts Subdivision located in the NE 1/4 of Section 25 and will be receptive to the submittal of a final plat, subject to resolution of technical discrepancies as identified by the City Planning Department and City Engineers, and payment of all applicable fees in Section 18.14 of the Land Division Ordinance and outstanding assessments if applicable. BE IT FURTHER RESOLVED, The Margin Note labeled “Subdivision Statistic #2 #4” shall be amended to include the phrase “or Municipal water service”. BE IT FURTHER RESOLVED, The Margin Note labeled “Restrictions #6” shall be amended to include Parcel 2.
