PCR2003096bAMENDED RESOLUTION #P.C. 096b-2003 APPROVAL OF AN AMENDED BUILDING, SITE AND OPERATION PLAN FOR CUSTOM AUTO REFINISHING AND CHRISTOPHER LEE CONCRETE STUDIOS LOCATED IN THE SW ¼ OF SECTION 17 (TAX KEY NO. 2228.999.009 / S83 W19025 SATURN DRIVE) WHEREAS, On June 25, 2003 plans were submitted by Christopher and Laura Tesch to amend the existing Building, Site and Operation Plan for the property located at S83 W19025 Saturn Drive, and revised plans were submitted on August 22, 2003, and further revisions were received on September 5, 2003, and WHEREAS, The existing property contains a 4,000 square foot manufacturing facility, housing an auto body repair shop, and WHEREAS, The property is zoned I-1 Industrial Park District, and the existing use is allowed by Conditional Use Grant, and said operations are in conformance to all the requirements of said zoning district and the previously approved Conditional Use Grant #119, and WHEREAS, The proposed amendment includes the addition of 5,400 square feet of floor area, 11 parking stalls, and related landscaping in conformance with said zoning district, and said addition is in conformance with the Zoning Code, and the proposed use is permitted by right in the I-1 Industrial Park District, and WHEREAS, The addition will be constructed to match the existing structure with a brick wainscoting on the east and south elevations, and metal wall panels throughout, and a standing seam metal roof and fascia will cover the addition. WHEREAS, The property is subject to the Muskego Design Guide, requiring 50% masonry, and the structure is representative of buildings in that area of the park, and WHEREAS, A stormwater detention area has been illustrated, and a grading and management plan has not been submitted as required, and WHEREAS, Said parcels will be serviced by Municipal Sewer and Water, and WHEREAS, No changes are proposed to signage, exterior lighting, or refuse collection and disposal, and WHEREAS, There is currently parking for 12 vehicles, and the proposal increases the parking area to thirteen (13) vehicles, but does not indicate the number of additional stalls, and WHEREAS, Many junk and/or dilapidated vehicles which are undergoing service are stored in the parking field, and the property is not compliant with Chapter 35 of the Municipal Code, Property Maintenance Code, and WHEREAS, An enhanced landscape plan has been provided that illustrates a diversity of species, and the plan will be reviewedhas been approved by the Conservation Coordinator / City Forester for compliance with City requirements, and WHEREAS, The landscape plan illustrates areas for garden displays. THEREFORE BE IT RESOLVED, That the Plan Commission approves of an amended Building, Site and Operation Plan for Christopher and Laura Tesch at the property located at S83 W19025 Saturn Drive. BE IT FURTHER RESOLVED, A grading and stormwater management plan shall behas been submitted for review and approvalapproved by the Building and Engineering Department prior to the release of building permits. BE IT FURTHER RESOLVED, All junk, inoperable, or vehicles in need of service shall be stored within the screened enclosure, and a fence detail shall be illustrated on the site plan and the property shall be compliant with the provisions of Chapter 35 of the Municipal Code prior to the release of building permits. BE IT FURTHER RESOLVED, All vehicles in the parking field to the east of the building are required to be parked on pavement, and the parking area shall be striped, and a plan shall be submitted to the Plan Commission for review. BE IT FURTHER RESOLVED, The landscape plans shall clearly demarcate the location of the display items and areas on the landscape plan, and said plan shall be approved by the Plan Commission prior to the release of building permits. BE IT FURTHER RESOLVED, That installation of the fence is required prior to building construction. BE IT FURTHER RESOLVED, That a copy of said plans be kept on file in the Building Department and that all aspect of this plan as they relate to landscape areas building facades and drainage shall be maintained in perpetuity unless otherwise authorized by the Plan Commission. BE IT FURTHER RESOLVED, That if occupancy is requested prior to the completion of landscaping and/or asphalting, a bond, letter of credit or cashiers check equal to twice the value of said costs must be submitted to the Planning Department. BE IT FURTHER RESOLVED, That failure to comply with the approval contained in this resolution shall result in the imposition of fines of $100 per day, the initiation of legal action, or both.
