PCR2003070RESOLUTION #P.C.070-2003 APPROVAL OF BUILDING SITE AND OPERATION PLAN AND CONDITIONAL USE GRANT AND DETERMINATION OF SUBSTANTIAL CHANGE TO THE MUSKEGO CENTRE PLANNED DEVELOPMENT DISTRICT FOR A DAY CARE CENTER FOR DISCOVERY DAYS CHILD CARE AT THE PROPERTY LOCATED IN THE NE ¼ OF SECTION 17 (JANESVILLE ROAD / TAX KEY NO. 2192.976) WHEREAS, Plans were submitted by Discovery Days Child Care for a Building, Site and Operation Plan and Conditional Use Grant and determination of a substantial change to the approved Muskego Centre Planned Development District for a day care center at the property located in the NE ¼ of Section 17 on May 22, 2003, and WHEREAS, The petitioner is proposing an approximately 5,000 square foot day care building, and WHEREAS, Said property is currently zoned B-2/OPD, Local Service Center District as modified by the Planned Development Overlay, and said use is a permitted use by Conditional Use Grant, and a public hearing has been scheduled before the Plan Commission on June 17, 2003, and WHEREAS, The proposal conforms to the bulk requirements of the zoning district, and WHEREAS, The adopted Conservation Plan does not outline the area for acquisition or management initiatives, and WHEREAS, The adopted 2003-2007 Park and Open Space Plan does not propose acquisitions in the area, and WHEREAS, The proposal is consistent with the 2010 Street System Plan, and WHEREAS, Said parcel will be serviced by municipal sanitary sewer and municipal water, and WHEREAS, The property is subject to Chapter 34 of the Municipal Code, and a stormwater management plan has been submitted, and said plan shall be reviewed by the Engineering Department, and WHEREAS, The facility will have approximately ten employees and accommodate approximately 60 children, and the operation of daycare facilities of this size is regulated by the State of Wisconsin, and WHEREAS, The hours of operation are projected to be 6am to 6pm, Monday through Friday, and WHEREAS, Access to the site will be provided through the existing drives to the west of Kwik Trip and by Overlook Bay Road, and WHEREAS, Two parking areas are proposed for a total of 25 vehicles, and the number of stalls appears sufficient for the intended use, and WHEREAS, Lighting and photometric plans have been submitted for review, and nine (9) 70- watt, high-pressure sodium vapor wall pack fixtures are illustrated on the building, and a single, 150-watt, high-pressure sodium vapor fixtures on a pole is illustrated at the entrance to the east parking area, and WHEREAS, The maximum height of the pole, fixture, and base is 15-feet as measured from grade, and the photometric plans have been forwarded to the City’s consulting engineers for review, and WHEREAS, Two fenced play areas are illustrated on the site plan, and the fencing will be black vinyl-coated chain link, and WHEREAS, A trash enclosure is proposed on-site, and the enclosure will be constructed from materials to match the building as required by the General Design Guide, and WHEREAS, The landscape plan has been reviewed by the City Forester, and revisions are necessary, and WHEREAS, No signage is proposed for the development, and all signage must be approved by the Plan Commission prior to installation. WHEREAS, The building is subject to the General Design Guide, and the building will be constructed with architectural block of varying sizes and face textures, and the colors proposed are red for the smaller block and beige for the larger, and a mansard roof with dimensional shingles wraps around the entire structure, and WHEREAS, The covered entry utilizes dry-vit, or EIFS, material, and the use of this material is for accent purposes and appears appropriate, and WHEREAS, Mechanicals are not illustrated on the plan, but must be screened from view. THEREFORE BE IT RESOLVED, That the Plan Commission approves of the Building, Site and Operation Plan and Conditional Use Grant for Discovery Days Child Care located in the NE ¼ of Section 17. BE IT FURTHER RESOLVED, The Plan Commission finds this proposed development to be a substantial change to the approved Muskego Centre Planned Development District, and recommends the same to the Common Council. BE IT FURTHER RESOLVED, A public hearing is required before the Common Council to amend the Planned Development District, and said hearing has been scheduled for June 24, 2003. BE IT FURTHER RESOLVED, The stormwater management plan must be approved by the City Engineer prior to the release of building permits. BE IT FURTHER RESOLVED, The photometric plans have been forwarded to the City’s consulting engineers for review, and compliance with the City’s requirements must be determined prior to the issuance of building permits. BE IT FURTHER RESOLVED, All disturbed areas on the site are required to be sodded, and these areas must be illustrated on the landscape plan. BE IT FURTHER RESOLVED, A revised landscaping plan shall be approved by the City Forester and Plan Commission prior to the release of building permits. BE IT FURTHER RESOLVED, A roof plan illustrating mechanicals shall be provided prior to the release of building permits. BE IT FURTHER RESOLVED, That a copy of said plans be kept on file in the Building Department and that all aspect of this plan as they relate to landscape areas and drainage shall be maintained in perpetuity unless otherwise authorized by the Plan Commission. BE IT FURTHER RESOLVED, That if occupancy is requested prior to the completion of landscaping and/or asphalting, a bond, letter of credit or cashiers check equal to twice the value of said costs must be submitted to the Planning Department. BE IT FURTHER RESOLVED, That failure to comply with the approval contained in this resolution shall result in the imposition of fines of $100 per day, the initiation of legal action, or both.
