PCR2003068RESOLUTION #P.C. 068-2003 RECOMMENDATION OF APPROVAL TO REZONE THE SCHMITT PROPERTY FROM A – AGRICULTURE DISTRICT TO THE R-3 COUNTRY HOME DISTRICT LOCATED IN THE SE ¼ OF SECTION 18 (TAX KEY Nos. 2232.980 AND 2232.981/ HILLENDALE DRIVE) WHEREAS, On May 16, 2003 a petition for rezoning was submitted by Edgewood Contractors, Inc. to rezone the Schmitt property from A – Agriculture District to the R-3 Country Home District and WHEREAS, A Public Hearing for the rezoning has been scheduled before the Common Council on June 24, 2003, and WHEREAS, The petition would permit unsewered residential development on lots of 40,000 square feet in area and 150 feet of average width, and WHEREAS, The 2010 Comprehensive Plan depicts the property for rural and agricultural use consistent with the A – Agriculture District or RCE Residential Country Estate District, and this proposal conflicts with this goal, and WHEREAS, The Common Council and Plan Commission have directed planning staff to develop a new Zoning Code, and unsewered residential development utilizing R-3 zoning standards is inconsistent with the DRAFT Chapter 40 Zoning Code, and implementation of the rezoning petition would result in non-conforming parcels upon adoption of Chapter 40. THEREFORE BE IT RESOLVED, That the Plan Commission does hereby recommend approval to the Common Council for the rezoning of the Schmitt property identified by Tax Key Numbers 2232.980 and 2232.981 from A – Agriculture District to R-3 Country Home District.
