PCR2003056RESOLUTION #P.C. 056-2003 APPROVAL OF A SKETCH LAND DIVISION FOR THE PROPERTY LOCATED IN THE SW ¼ OF SECTION 11 (TAX KEY NO. 2203.988) WHEREAS, On April 25, 2003 a sketch for a five (5) lot land division was submitted by Bill Carity for the Quietwood South LLC property located in the SW ¼ of Section 11, and WHEREAS, The property is currently zoned RS-2 Suburban Residence District, requiring a minimum lot size of 20,000 square feet and an average minimum width of 110 feet, and the parcels meet this requirement, and WHEREAS, The proposal will be serviced by City sanitary sewer and municipal water, and WHEREAS, The 2010 Street System Plan depicts Woods Road to have a 100-foot ultimate right of way width and Mystic Drive a 60-foot ultimate right-of-way, and dedications to their full widths are required at this time, and WHEREAS, The proposed land division is insufficient in size to require Stormwater Management pursuant to Chapter 34 of the Municipal Code, and stormwater management facilities are illustrated, and WHEREAS, The petitioner may be able to reconfigure Lots 4 and 5 to include an additional platted parcel with the absence of the stormwater ponds. THEREFORE BE IT RESOLVED, That the Plan Commission approves of a sketch land division as submitted by Bill Carity for Quietwood South LLC for the property located in the SW ¼ of Section 11 and will be receptive to the submittal of a Certified Survey Map. BE IT FURTHER RESOLVED, That the Certified Survey Map shall dedicate Woods Road and Mystic Drive to their ultimate width. BE IT FURTHER RESOLVED, That the stormwater management ponds not be constructed as illustrated. BE IT FURTHER RESOLVED, That the petitioner may submit a Certified Survey Map that reconfigures Lots 4 and 5 into three total parcels. BE IT FURTHER RESOLVED, Access to Woods Road shall be restricted to a single access point if Lots 4 and 5 are not reconfigured, and a cross-access easement will be required. BE IT FURTHER RESOLVED, That two access points to Woods Road will be allowed in the event Lots 4 and 5 are reconfigured, and cross-access easement will be required for the two parcels with a shared access point. BE IT FURTHER RESOLVED, That this approval is granted in concept only and final action is only an indication of the current intent of the Plan Commission; Final submittals are subject to future review and consideration by the Plan Commission, municipal committees of jurisdiction, and other agencies, and approval of final plans is not guaranteed by this action of the Plan Commission.
