PCR2003053RESOLUTION #P.C.053-2003 APPROVAL OF BUILDING SITE AND OPERATION PLAN AND CONDITIONAL USE GRANT FOR A MINI-WAREHOUSE FOR GEORGE ALEX AT THE PROPERTY LOCATED IN THE SE ¼ OF SECTION 25 (W125 S9912 NORTH CAPE ROAD / TAX KEY NO. 2260.999) WHEREAS, Plans were submitted by George Alex for a Building, Site and Operation Plan and Conditional Use Grant for a mini-warehouse, self-storage building at the Alex property located in the SE ¼ of Section 25 on March 13, 2003, and WHEREAS, The petitioner is proposing an approximately 6,900 square foot self-storage structure, and WHEREAS, Said property is currently zoned B-4, Highway Business District, and said use is a permitted use by Conditional Use Grant, and a public hearing has been scheduled before the Plan Commission on May 6, 2003, and WHEREAS, The adopted Conservation Plan does not outline the area for acquisition or management initiatives, and WHEREAS, The adopted 2003-2007 Park and Open Space Plan does not propose acquisitions in the area, and WHEREAS, The proposal is consistent with the 2010 Street System Plan, and WHEREAS, Said parcel will be serviced by municipal sanitary sewer and private well, and WHEREAS, The property is subject to Chapter 34 of the Municipal Code, and a stormwater management plan has been submitted, and initial review comments by the Engineering Department regarding the submittal indicated there are technical issues that must be resolved, and WHEREAS, The site plan illustrates a new asphalt drive to access the site, and a gravel drive currently exists allowing access to the utility building located at the south edge of the property, and WHEREAS, The site plan illustrates a paved access to all sides of the building, and the plans have been provided to the Fire Department for review, but comment has not been received, and WHEREAS, TRANS 220 review by the Wisconsin Department of Transportation is required, and this has not occurred, and WHEREAS, A total of 4 parking stalls are provided and this is sufficient for the routine use of the building. WHEREAS, No lighting is proposed for the development, and WHEREAS, The Police Department has expressed concerns regarding site security, and security issues should be addressed, and WHEREAS, No trash enclosure is proposed on-site, and WHEREAS, The landscape plan has been reviewed by the City Forester, and revisions are necessary, and WHEREAS, No signage is proposed for the development, and all signage must be approved by the Plan Commission prior to installation. WHEREAS, The building is subject to the Durham Hill Design Guide, and the building is proposed to be constructed with “Decade 90” brick, and cedar siding, and WHEREAS, Overhead doors are proposed to be metal panel, but their color is not indicated, and roofing materials are proposed to be dimensional asphalt shingle, and WHEREAS, Mechanicals are not illustrated on the plan, but must be screened from view, and WHEREAS, Cupolas with finials are illustrated to adorn the roof, and the office entry includes a “country trading post” element, and the building represents the intent of the Design Guide. THEREFORE BE IT RESOLVED, That the Plan Commission approves of the Building, Site and Operation Plan and Conditional Use Grant for a mini-warehouse, self-storage building submitted March 13, 2003 by George Alex for property located in the SE ¼ of Section 25. BE IT FURTHER RESOLVED, The stormwater management plan must be approved by the Public Works Committee prior to the release of building permits. BE IT FURTHER RESOLVED, The property will be afforded only one access point, and the gravel drive shall be removed, and a cross-access easement shall be recorded with the Waukesha County Register of Deeds to provide access to the utility building prior to the release of building permits. BE IT FURTHER RESOLVED, That TRANS 220 approval shall be received prior to the release of building permits. BE IT FURTHER RESOLVED, All disturbed areas on the site are required to be sodded, and these areas must be illustrated on the landscape plan. BE IT FURTHER RESOLVED, A revised landscaping plan shall be approved by the City Forester and Plan Commission prior to the release of building permits. BE IT FURTHER RESOLVED, Security lighting shall be illustrated on the site plan, and photometric plans are required to be approved by the Plan Commission prior to the release of building permits. BE IT FURTHER RESOLVED, That a copy of said plans be kept on file in the Building Department and that all aspect of this plan as they relate to landscape areas and drainage shall be maintained in perpetuity unless otherwise authorized by the Plan Commission. BE IT FURTHER RESOLVED, That if occupancy is requested prior to the completion of landscaping and/or asphalting, a bond, letter of credit or cashiers check equal to twice the value of said costs must be submitted to the Planning Department. BE IT FURTHER RESOLVED, That failure to comply with the approval contained in this resolution shall result in the imposition of fines of $100 per day, the initiation of legal action, or both.
