PCR2003035RESOLUTION #P.C. 035-2003 APPROVAL OF A SKETCH PRELIMINARY PLAT FOR THE EDGEWOOD CONTRACTORS PROPERTY, LOCATED IN THE SE 1/4 OF SECTION 18 (HILLENDALE DRIVE / TAX KEY NO. 2232.980) WHEREAS, on March 20, 2003 a sketch for a preliminary plat was submitted by Edgewood Contractors for property located in the SE 1/4 of Section 18, and WHEREAS, Said plat consist of approximately 15.62 acres, and proposes 21 lots, ranging from 43,561 square feet to 185,578 square feet in size, and WHEREAS, Said property is zoned A – Agriculture District, requiring a minimum lot size of 120,000 square feet and an average minimum width of 300 feet, and said lots do not meet said minimum zoning requirements, and WHEREAS, The 2010 Comprehensive Plan depicts this area as being set aside for agricultural rural development at densities not to exceed on parcel per 2.75 acres, and the proposal is not within this goal, and WHEREAS, Said parcels will be serviced by private sanitary systems and public water, and insufficient information is available to determine adequacy soils to support on-site sanitary systems, and WHEREAS, The adopted Conservation Plan depicts portions of the property as high priority acquisition areas, and no accommodation has been made to provide for this priority, and WHEREAS, The adopted 2003-2007 Park and Open Space Plan does not depict active parkland acquisitions in this area, and WHEREAS, The proposal dedicates Hillendale Drive to its ultimate width is depicted on the 2010 Street System Plan, and WHEREAS, the proposed plat is subject to the requirements of Chapter 34 of the Municipal Code pertaining to stormwater management, and no accommodation has been made to provide for such facilities, and WHEREAS, The Plan Commission requires all wetlands to be placed in outlots to be owned and maintained by an incorporated Home Owners Association, and no accommodation has been made to provide for such configuration, and WHEREAS, The property is bisected by a navigable waterway and it is the opinion of the Wisconsin Attorney General that “a river, stream, or creek that crosses a parcel legally divides said parcel as a highway would,” and no provisions has been made for such parcel configurations. THEREFORE BE IT RESOLVED, That the Plan Commission approves of a 15.62 acre, 21 lot, sketch preliminary plat for the Edgewood Contractors property, located in the SE 1/4 of Section 18 and will be receptive to the submittal of a preliminary plat. BE IT FURTHER RESOLVED, That this approval is granted in concept only and final action is only an indication of the current intent of the Plan Commission; Final submittals are subject to future review and consideration by the Plan Commission, municipal committees of jurisdiction, and other agencies, and approval of final plans is not guaranteed by this action of the Plan Commission.
