PCR2003032AMENDED RESOLUTION #P.C.032-2003 APPROVAL OF BUILDING SITE AND OPERATION PLAN FOR WALGREENS LOCATED IN THE NW ¼ OF SECTION 16 AND NE ¼ OF SECTION 17 (TAX KEY NOs. 2222.984.002, 2225.987.988, 2225.989 AND 2225.990) WHEREAS, On March 7, 2003 plans were submitted by Redmond Development dba MRED (Janesville / Racine) Associates LP for a Building, Site and Operation Plan for Walgreens, located in the NW ¼ of Section 16 and NE ¼ of Section 17, and WHEREAS, Said property is currently zoned B-2 Local Service Center District, and said use is a permitted use by right subject to Building Site and Operation Plan approvals, and WHEREAS, Petitioner proposes to construct a 14,560 square foot building, and said building meets the bulk requirements of the Zoning Code, and WHEREAS, Said building is subject to the architectural standards detailed in the Downtown Design Guide, and the Plan Commission finds these standards to be met, and WHEREAS, Cross access is provided as required by the Downtown Design Guide, and WHEREAS, Access to Racine Avenue and Janesville Road are under the jurisdiction and authority of the Waukesha County Department of Transportation, and WHEREAS, Parking for 58 cars is required, and 72 stalls are proposed, and WHEREAS, Stormwater management plans have been submitted for review by the Public Works Committee, and WHEREAS, A five foot wide recreation trail is proposed to be installed, and City standards require an 8 foot wide trail, and WHEREAS, A Landscape Plan has been submitted for review, and the City Forester has found it to be of insufficient scope to meet City standards, and WHEREAS, Photometric Plans have been provided, and said plans do not utilize the fixtures and specifications required by the Downtown Design Guide, and WHEREAS, Said parcels will be serviced by municipal sanitary sewer and water services, and WHEREAS, The proposal includes Parcel 1 and Parcel 2 of a Certified Survey Map addressed by Plan Commission Resolution #PC 031-2003, and WHEREAS, Parcel 1 includes 8 structures to be razed as a part of this proposal, and WHEREAS, Parcel 2 includes three structures to be razed as a part of this approval, and WHEREAS, All trash receptacles and mechanicals are screened as required by the Downtown Design Guide, and WHEREAS, A monument sign with reader board, and two wall signs are proposed, and said signs meet the bulk requirements of the Zoning Code. THEREFORE BE IT RESOLVED, That the Plan Commission approves of the Building, Site and Operation Plan submitted by Redmond Development dba MRED (Janesville / Racine) Associates LP for a Building, Site and Operation Plan for Walgreens, located IN THE NW ¼ of Section 16 and NE ¼ of Section 17. BE IT FURTHER RESOLVED, That all access points to Janesville Road and Racine County must be approved in writing by the Waukesha County Department of Transportation prior to release of building permits. BE IT FURTHER RESOLVED, That a Developers Agreement is required to be executed prior to release of building permits and / or the construction of on site improvements. BE IT FURTHER RESOLVED, A photometric plan is required to be approved by the Plan Commission prior to release of building permits. BE IT FURTHER RESOLVED, A landscape plan is required to be approved by the Plan Commission prior to release of building permits. BE IT FURTHER RESOLVED, The Certified Survey map approved by resolution #PC 031-2003 shall be recorded prior to release of building permits. BE IT FURTHER RESOLVED, That the eight structures on Parcel 1 are to be razed within 6 months of recording the Certified Survey Map. BE IT FURTHER RESOLVED, That the three structures on Parcel 2 are to be razed within 24 months of recording the Certified Survey Map. BE IT FURTHER RESOLVED, That a copy of said plans be kept on file in the Building Department and that all aspect of this plan as they relate to landscape areas and drainage shall be maintained in perpetuity unless otherwise authorized by the Plan Commission. BE IT FURTHER RESOLVED, That if occupancy is requested prior to the completion of landscaping and/or asphalting, a cash bond equal to twice the value of said costs must be submitted to the Planning Department. BE IT FURTHER RESOLVED, That failure to comply with the approval contained in this resolution shall result in the imposition of fines of $100 per day, the initiation of legal action, or both. The proposed sign’s message will be changed no more than once a day. The message will not be scrolling.
