PCR2003029RESOLUTION #P.C. 029-2003 APPROVAL OF A CERTIFIED SURVEY MAP FOR THE WERNETTE PROPERTY LOCATED IN THE NE AND NW ¼ OF SECTION 11 (TAX KEY NO. 2203.999) WHEREAS, On February 20, 2003 a Certified Survey Map for a four (4) lot land division was submitted by Thomas Wernette for the property located in the NE and NW ¼ of Section 11, and WHEREAS, The Plan Commission approved a sketch of the land division by Resolution #PC 099-2002, and WHEREAS, The property is currently zoned RS-2 Suburban Residence District, requiring a minimum lot size of 20,000 square feet and an average minimum width of 110 feet, and the parcels appear to meet this requirement, and WHEREAS, four (4) accessory structures currently exist on the parcel totaling 1,958 square feet, and the parcel is allowed 2,010 square feet of accessory structures, and said accessory structures do not appear to meet the setback and offset requirements of the RS-2 District in respect to the proposed land division, and WHEREAS, The proposal will be serviced by City sewer and water, and WHEREAS, The 2003-2007 Park and Open Space Plan identifies a recreational trail located within the public right-of-way on the north side of Woods Road, and WHEREAS, The 2010 Street System Plan depicts Woods Road to have a 100-foot ultimate right of way width, and the right-of-way is dedicated to its full width, and THEREFORE BE IT RESOLVED, That the Plan Commission approves of a four (4) lot Certified Survey Map as submitted by Thomas Wernette for the property located in the NE and NW ¼ of Section 11 subject to resolution of technical discrepancies as identified by the City Planning Department and City Engineers, and payment of all applicable fees in Section 18.14(3) of the Land Division Ordinance and outstanding assessments if applicable. BE IT FURTHER RESOLVED, That a digital file of this CSM shall be submitted to the City in accordance with Common Council Ordinance No. 1118 and Resolution 196- 2002. BE IT FURTHER RESOLVED, That any structures which conflict with property lines or that do not meet the minimum setback and offsets shall be annotated for removal at owners expense within one (1) year of the date of recording of the Certified Survey Map. BE IT FURTHER RESOLVED, That Developer’s Agreement shall be required to ensure the installation of the recreational trail located within the public right-of-way on the north side of Woods Road as identified in the 2003-2007 Park and Open Space Plan, and said Agreement shall be executed prior to recording of the Certified Survey Map.
