APPROVAL OF A THREE LOT LAND DIVISION FOR THE LEVENHAGEN PROPERTY
LOCATED IN THE NW ¼ OF SECTION 25 (TAX KEY NO. 2258.998 / S95 W13252 RYAN ROAD)
WHEREAS, On January 29, 2003 a Certified Survey Map was submitted by Sherry Levenhagen
for a three (3) lot land division of the Levenhagen property located in the NW ¼ of Section 25,
(Tax Key No. 2258.998), and
WHEREAS, The proposed land division would create lots with a minimum area of approximately
40,266 square feet and an average minimum width of 110 feet, and
WHEREAS, Said property is zoned RS-3, Suburban Residence District, requiring a minimum lot
size of 15,000 square feet and an average minimum width of 100 feet, and parcels appear to
meet said minimum zoning requirements, and
WHEREAS, The 2010 Comprehensive Plan depicts this area as being set aside for medium
density residential development and this proposal is within this goal, and
WHEREAS, The 2010 Street System Plan depicts Ryan Road to be a 66 foot ultimate right-of-
way abutting the parcels, and the proposal is consistent with the Plan, and
WHEREAS, Said parcels will be serviced by public sewer and private water facilities, and
WHEREAS, Parcel 3 contains a 12’ x 8’ accessory structure, and accessory structures are not
permitted on a parcel without a primary structure being present.
THEREFORE BE IT RESOLVED, That the Plan Commission approve of a Certified Survey Map
being submitted creating a three (3) lot land division of the Levenhagen property located in the
NW ¼ of Section 25, (Tax Key No. 2258.998) subject to resolution of technical discrepancies as
identified by the City Planning Department and City Engineers, and payment of all applicable
fees in Section 18.14(3) of the Land Division Ordinance and outstanding assessments if
applicable.
BE IT FURTHER RESOLVED, That the Plan Commission determines that the 12’ x 8’
accessory structure on Parcel 3 shall be relocated to a conforming location on Parcel 2, or shall
be razed within one year of the recording of this CSM, whichever occurs first, and this
requirement shall be illustrated on the CSM.
BE IT FURTHER RESOLVED, That a digital file of this CSM shall be submitted to the City in
accordance with Common Council Ordinance No. 1118 and Resolution 196-2002.
