PCR2003007RESOLUTION #P.C. 007-2003 APPROVAL OF REPLACEMENT SIGNS FOR LOOMIS PETRO MART FOR THE PROPERTY LOCATED AT S107 W16311 LOOMIS ROAD / TAX KEY NO. 2296.996 WHEREAS, Plans to replace the existing pole sign was submitted by Baljit Dhillon for the property located at S107 W16311 Loomis Road / Tax Key No. 2296.996 on January 3, 2003, and WHEREAS, The property is zoned B-4, Highway Business Distirct, and building and site signs are permitted subject to Section 17:6.09 of the Zoning Code, and WHEREAS, A free-standing sign pole currently exists on the parcel, and is legal non-conforming due to height and setback, and WHEREAS, The petitioner is proposing a 49 SF pole sign to be mounted on the existing pole, and conformity with the zoning code can not be determined without height and setback information provided by petitioner, and WHEREAS, The sign will be internally illuminated, and WHEREAS, Such signage requires Plan Commission approval prior to the issuance of a building and zoning permit, and THEREFORE BE IT RESOLVED, That the Plan Commission approves the installation of a 49 square foot pole sign signs for the Loomis Petro Mart property. BE IT FURTHER RESOLVED, That the non conforming sign structure may be reused, as the degree of nonconformity is not being increased, and the value of the improvement does not exceed 50% of the value. BE IT FURTHER RESOLVED, That the sign plans are approved as submitted and a copy of said plans be kept on file in the Building Department and that all aspect of this plan shall be maintained in perpetuity unless otherwise authorized by the Plan Commission. BE IT FURTHER RESOLVED, That failure to comply with the approval contained in this resolution shall result in the imposition of fines of $100 per day, the initiation of legal action, or both.
