PCR2002163RESOLUTION #P.C. 163-2002 DETERMINATION OF NON-SUBSTANTIAL CHANGE TO THE APPROVED DREAMLAND APPROVAL OF BUILDING SITE AND OPERATION PLAN AMENDMENT AND PLANNED DEVELOPMENT DISTRICT AT MOORLAND AND JANESVILLE ROADS I TAX KEY NO. 2167.995.008 WHEREAS, On November 7,2002 plans to screen the compactor mechanicals was submitted by Schrader and Holt Architects, Ltd. on behalf of Kohl's Department Stores for the Dreamland Planned Development at Moorland and Janesville Roads I Tax Key No. 2167.995.008, and WHEREAS, The property is zoned B-310PD. General Business District as modified by the Planned Development District, and building and site signs are permitted subject to Section 17:6.09 of the Zoning Code, and WHEREAS, The screening of all mechanicals on the property is a condition imposed on the project by the Plan Commission in Resolution # PC 080-2001, and WHEREAS, The petitioner is proposing an 8-foot high brick wall with cedar gates, and all brick will match the existing structure, and THEREFORE BE IT RESOLVED, That the Plan Commission approves of an amendment to the Building Site and Operation plan for the Dreamland Planned Development at Moorland and Janesville Roads. BE IT FURTHER RESOLVED, That the Plan Commission determines this to be a non-substantial change to the approved Dreamland Planned Development District and no public hearing shall be required. plans be kept on file in the Building Department and that all aspect of this plan shall be BE IT FURTHER RESOLVED, That the plans are approved as submitted and a copy of said maintained in perpetuity unless otherwise authorized by the Plan Commission. BE IT FURTHER RESOLVED, That failure to comply with the approval contained in this resolution shall result in the imposition of fines of $100 per day, the initiation of legal action, or both.
