PCR2002137RESOLUTION #P.C. 137-2002 AND RECOMMENDATION TO COMMON COUNCIL TO REZONE THE PROPERTY FROM APPROVAL OF A FINAL PLAT OF CHAMBERLAIN HILL (F.K.A. CEDAR MILL HEIGHTS) RSE SUBURBAN ESTATE DISTRICT TO RSE I COPD RESIDENTIAL SUBURBAN ESTATE LOCATED IN THE SE ‘A OF SECTION 3 (TAX KEY NO. 2171.999.001 I MARTIN DRIVE). DISTRICT WITH CONSERVATION PLANNED DEVELOPMENT OVERLAY DISTRICT, WHEREAS, On September 16, 2002 a final plat was submitted by Chamberlain Hill LLC for Chamberlain Hill Subdivision located in the SE ‘A of Section 3, and WHEREAS, Said plat consist of approximately 29.52 acres, and proposes 29 residential parcels, three outlots. and ranging from approximately 16,020 square feet to approximately 19,658 square feet in size, and WHEREAS, Said property is zoned RSE Suburban Estate District, and is proposed to be rezoned to include the COPD Conservation Planned Development Overlay District, and a public hearing has been held before the Common Council regarding said rezoning, and WHEREAS, The final plat proposes four residential parcels in addition to the base density permitted by the RSE District, and said parcels may be permitted provided that criteria of Section 18.81(2) of the Land Division Ordinance are found to be met, and WHEREAS, The Plan Commission finds that the petitioner has met three of the eight criteria of Section I8.81(2) of the Land Division Ordinance, being: Preservation of environmental features identified in the Conservation Plan. a Improves water quality through stormwater management practices which exceed the Restores native prairie and provides a management plan for perpetual maintenance. minimum standards of Chapter 34 of the Municipal Code. and has met the requirements to warrant the density bonus of four residential parcels, and WHEREAS, The 2010 Comprehensive Plan depicts this area for rural density residential development at densities not exceeding 1.0 dwelling units per acre, and the final plat provides a density of 1 .O dwelling units per acre, and WHEREAS, Said parcels will be serviced by public sanitary sewer and water facilities, and WHEREAS, The 2010 Street System Plan depicts Martin Drive to have an 50 foot wide ultimate right-of way and the appropriate dedications are illustrated, and WHEREAS, The Plan Commission’s preliminary plat approval required a vehicular access restriction along Field Drive, and said restriction is not depicted on the final plat, and WHEREAS, Wetlands, woodlands, and steep slopes are present on the subject parcel, and a Detailed Site Analysis and mitigation plan has been previously approved by the Plan Commission, and a WHEREAS, The Conservation Plan depicts the Outlot 2 parcel as having low priority Land Management objectives. and a Management Plan for the outlots is approved concurrent with the Final Plat, and b WHEREAS, The Plan Commission's preliminary plat approval required the submittal of detailed Street Tree and Landscape Plans and said plans have not been submitted at this time, and WHEREAS, The 2001-2005 Park and Open Space Plan does not identify any land acquisitions in the area, and WHEREAS, The Plan Commission's preliminary plat approval required the illustration of all utility cable utilities, or other utilities of jurisdiction, and the plat does not depict all utilities. easements on the final plat, and no easements are depicted for natural gas, electric, telephone, or THEREFORE BE IT RESOLVED, That the Plan Commission recommends approval to the Common Council of a 29.52 acre, 29 parcel, 3outlot. final plat for Chamberlain Hill Subdivision by Chamberlain Hill LLC located in the SE !4 of Section 3, subject to resolution of technical discrepancies as identified by the City Planning Department and Building and Engineering Department, and payment of all applicable fees in Section 18.14 of the Land Division Ordinance and outstanding assessments if applicable. BE IT FURTHER RESOLVED, That prior to approval by the Common Council, the final plat shall all utility easements as approved by the City Planning Department and Building and Engineering Department. BE IT FURTHER RESOLVED, That prior to execution by City Officials, the right-of-way for all off- site improvements shall be acquired, and off-site utility plans shall be approved by the Public Works Committee and Common Council. BE IT FURTHER RESOLVED, That prior to the release of residential permits, the Street Tree Plans shall be approved by the Conservation Coordinator and Plan Commission.
