PCR2002135RESOLUTION #P.C. 135-2002 APPROVAL OF A PRELIMINARY PLAT AND CONCEPTUAL REZONING TO INCLUDE COPD CONSERVATION PLANNED DEVELOPMENT OVERLAY DISTRICT FOR BIG MUSKEG0 ESTATES ADDITON II ON THE MAY PROPERTY BY TOWNE REALTY, LOCATED IN THE SE 'A OF SECTION 13 (TAX KEY NO. 221 1.998 I SCHAEFER DRIVE) WHEREAS, On October 9, 2002 a preliminary plat and rezoning request was submitted by Towne Realty for the May property located in the SE % of Section 13, and WHEREAS, The Plan Commission approved of the concept of Big Muskego Estates II by Resolution #PC 103-2002 on August 6, 2002, and WHEREAS, The plat consists of approximately 39 acres, proposes 34 parcels, and provides approximately 19.66 acres of common open space, and WHEREAS, Said property is zoned RSE Suburban Estate District and a rezoning to RSE / COPD would be required in order to implement the preliminary plat, and WHEREAS, Said RSE / COPD District recommends a maximum lot size of 20,000 square feet and a maximum lot width of 100 feet, and the Preliminary Plat conforms to these standards, and WHEREAS, The preliminary plat proposes four residential parcels in addition to the base density permitted by the RSE District, and said parcels may be permitted provided that four of the eight criteria of Section 18.81(2) of the Land Division Ordinance are found to be met, and WHEREAS, A public hearing on the rezoning petition is scheduled by the Common Council for November 26,2002, and WHEREAS, The 2010 Comprehensive Plan depicts this area for residential development at a density not to exceed one dwelling unit per acre, and the yield plan illustrates a density of 0.96 dwelling units per acre, and WHEREAS, A Detailed Site Analysis has been provided, and the Conservation Coordinator has indicated that it does meet the minimum standards of Section 18.21 of the Land Division Ordinance, and WHEREAS, Said parcels are proposed to be serviced by City sewer, subject to SEWRPC and DNR concurrence with amendments to the adopted 208 Service Area Plan, and WHEREAS, Said parcels may be served by private water systems or may be served by municipal water if demonstrated to be economical, and WHEREAS, The Conservation Plan depicts the woodland on the property as a low management priority, and said areas are proposed to be preserved, and a WHEREAS, The plat is required to provide on-site stormwater management as required by Chapter 34, and the preliminary plat accommodates this. THEREFORE BE IT RESOLVED, That the Plan Commission approves of a 39 acre, 34 parcel Preliminary Plat of Big Muskego Estates II for the May property as proposed by Towne Realty, and located in the SE 'A of Section 13 and will be receptive to the submittal of a final plat subject to resolution of technical discrepancies as identified by the City Planning Department and City Engineers, and payment of all applicable fees in Section 18.14 of the Land Division Ordinance and outstanding assessments if applicable. BE IT FURTHER RESOLVED, That this approval is subject to SEWRPC and DNR approval of sanitary sewer service area amendments for the subject land. BE IT FURTHER RESOLVED, That the Plan Commission recommends to the Common Council that the parcel be rezoned to RSE I COPD Suburban Residence District with Planned Development Overlay District, being a recommended maximum parcel size of 20,000 square feet and a recommended average parcel width of 100 feet. 0 BE IT FURTHER RESOLVED, That the Plan Commission recommends private ownership of Outlots 3 and 4 by an incorporated Home Owners Association, with all maintenance obligations depicted in a recorded Open Space Management Plan. BE IT FURTHER RESOLVED, That the final plat shall include easements as required by the utilities of jurisdiction, and shall include 5 foot wide street tree easements on both sides of all rights-of-way.
