AMENDED
i) APPROVAL OF BUILDING SITE AND OPERATION PLAN AMENDED AND DETERMINATION OF NON-
SUBSTANTIAL CHANGE TO THE APPROVED DREAMLAND PLANNED DEVELOPMENT DISTRICT
AT MOORLAND AND JANESVILLE ROADS / TAX KEY NO. 2167.995
WHEREAS, On August 1, 2002 revised site plans were submitted by Mike Wolf on behalf of Kohl's
Department Stores for the Dreamland Planned Development at Moorland and Janesville Roads I Tax Key
No. 2167.995, and
WHEREAS, The property is zoned BdlOPD, General Business District as modified by the Planned
Development District, and Building Site and Operation Plans are subject to Section 17:6.11 of the Zoning
Code, and
WHEREAS, The development was previously approved by Resolution #P.C. 132c-99, Resolution #PC.
080-2001. and Resolution #P.C. 048-2002, and
WHEREAS, The petitioner is proposing to grade and seed the area originally designated for Jewel-Osco
customer parking, and
WHEREAS, A continuous curb will be installed to prevent traffic from inadvertently accessing the future
Jewel-Osco parking area, and
WHEREAS, Lighting will be installed along the access drive to Moorland Road, and & the fixtures
along the access drives in the Jewel-Osco future parking area will be installed, and
0 petitioner for review, and
WHEREAS, A revised photometric plan and revised fixture specifications have been submitted by the
WHEREAS, An 8-foot wide sidewalk in front of the Kohl's Department Store will be installed rather that
25-feet of pavement, and
WHEREAS, The previously approved Interim Landscaping Plan requires the developer to install sod on
all Outlots, expansion areas, and future phase retail pads.
THEREFORE BE IT RESOLVED, That the Plan Commission approves of an amendment to the Building
Site and Operation Plan for the Dreamland Planned Development at Moorland and Janesville Roads.
BE IT FURTHER RESOLVED, That a cash deposit equal to double the cost to sod all areas determined
by the Plan Commission to be seeded in the Development shall be required, until such time as it is
determined by the City Engineer that effective site restoration and vegetative cover exists.
BE IT FURTHER RESOLVED, That the Plan Commission determines this to be a non-substantial change
to the approved Dreamland Planned Development District and no public hearing shall be required.
BE IT FURTHER RESOLVED, That failure to comply with the approval contained in this resolution shall
result in the imposition of fines of $100 per day, the iniliation of legal action, or both.
BE IT FURTHER RESOLVED, That the Director of Engineeringhilding Inspection determines an
established rate of seed coverage by a specific date in the Spring of 2003.
