PCR2002098RESOLUTION #P.C. 098-2002 APPROVAL OF A LAND DIVISION FOR THE HElN PROPERTY LOCATED IN THE NE % OF SECTION 12 (TAX KEY NO. 2205.999.030 AND 2205.982 I TESS CORNERS DRIVE) WHEREAS, A Certified Survey Map was submitted by David Hein for a one (1) lot land division of the Hein property located in the NE % of Section 12, (Tax Key No. 2205.999.030 and 2205.982 I Tess Corners Drive), and WHEREAS, Said property is zoned RS-2, Suburban Residence District, requiring a minimum lot size of 20,000 square feet and an average minimum width of 110 feet, and the proposed parcel meets these requirements, and WHEREAS, The petitioner proposes to access the parcel through a 60-foot wide street reservation connecting to Tess Corners Drive, and, WHEREAS, The 2010 Comprehensive Plan depicts this area as being set aside for medium density residential development, and this proposal is within this goal, and WHEREAS, The 2010 Street System Plan depicts Tess Corners Drive to have a 100-foot ultimate right of way width, and the right-of-way has not been dedicated to its full width, and water mark have been illustrated, and WHEREAS, The proposed parcel contains a navigable waterway and the meander line and ordinary high- WHEREAS, The navigable stream setback and shoreland jurisdictional limits are to be measured from the ordinary high-water mark, and WHEREAS, it is the opinion of the Attorney General that “a river, stream, or creek that crosses a parcel legally divides said parcel as a highway would.” and said division is properly illustrated on the Final Certified Survey Map, and WHEREAS, The property will be served by private water systems, and WHEREAS, The Public Utility Committee has requested that City of Franklin provide sanitary sewer service to the property, and in the event said request is denied, has authorized the use of private on site sanitary facilities, and WHEREAS, The Park Board has recommended payment of a park fee in lieu of land dedication, and THEREFORE BE IT RESOLVED, That the Plan Commission approves of a Certified Survey Map being submitted for a one (1) lot land division of the Hein property located in the NE X of Section 12 subject to resolution of technical discrepancies as identified by the City Planning Department and City Engineers, assessments if applicable. and payment of ail applicable fees in Section 18.14(3) of the Land Division Ordinance and outstanding BE IT FURTHER RESOLVED, That the Public Utilities Committee shall make a determination regarding sewer service to the property. BE IT FURTHER RESOLVED, That the Certified Survey Map shall dedicate Tess Corners Drive to a 100 foot ultimate width. street reservation shall be annotated for removal at owners expense upon City acceptance of the street BE IT FURTHER RESOLVED, That any structures which conflict with the location of the 60 foot wide reservation.
