RECOMMENDATION OF APPROVAL OF A PRELIMINARY PLAT FOR THE
CHAMBERLAIN HILL SUBDIVISION BY CEDAR MILL HOMES LOCATED IN
THE SE 1/4 OF SECTION 3 (TAX KEY N0.2171.999.001)
WHEREAS, On June 24, 2002 a preliminary plat was submitted by Cedar Mill
Homes for Chamberlain Hill Subdivision located in the SE 114 of Section 3, and

WHEREAS, On July 16, 2002 a revised preliminary plat was received which
addressed all technical corrections identified by the Planning Department,
Building & Engineering Department, and the City’s consulting engineers, and
WHEREAS, Said plat consist of 28.7 acres, and proposes 29 lots, ranging from
16,020 square feet to 19,702 square feet in size, and four Outlots, and
WHEREAS, Said property is zoned RSE Residential Suburban Estate District
requiring a minimum lot size of 40,000 square feet and a minimum average width
of 150 feet. and
WHEREAS, ON June 24, 2002 a petition to rezone the property to RSE / COPD
Residential Suburban Estate District with Conservation Planned Development
District was received, and
a WHEREAS, Said RSE / COPD District recommends a maximum lot size of
20,000 square feet and a maximum lot width of 100 feet, and the Preliminary
Plat conforms to these standards, and
WHEREAS, On July 23, 2002 the Common Council held a public hearing on the
rezoning petition, and
WHEREAS, The Plan Commission approved of the concept of Chamberlain Hill
by Resolution #PC 044-2002 on March 19,2002, and
WHEREAS, The 2010 Comprehensive Plan depicts this area for residential
development, and the proposal is consistent with the Plan, and
WHEREAS, Said parcels will be serviced by City sewer and water, and
WHEREAS, The 2010 Street System Plan depicts Martin Drive to be a 100 foot
wide ultimate right-of-way, and the Preliminary Plat is in conformance with this
requirement, and
WHEREAS, The Conservation Plan depicts Outlot 2 as a low priority e management area, and the Preliminary Plat includes the preservation of these
lands, and
WHEREAS, A Detailed Site Analysis has been provided, and the Conservation
Coordinator has indicated that it does meets the minimum standards of Section e 18.21 of the Land Division Ordinance, and
WHEREAS, The preliminary plat proposes four residential parcels in addition to
the base density permitted by the RSE District, and said parcels may be
permitted provided that four of the eight criteria of Section 18.81(2) of the Land
Division Ordinance are found to be met, and
THEREFORE BE IT RESOLVED, That the Plan Commission recommends
approval to the Common Council of a 28.7 acre, 29 Parcel, Preliminary Plat for
the Chamberlain Hill Subdivision by Cedar Mill Homes located in the SE 1/4 of
Section 3 and will be receptive to the submittal of a final plat, subject to
resolution of technical discrepancies as identified by the City Planning
Department and City Engineers, and payment of all applicable fees in Section
18.14 of the Land Division Ordinance and outstanding assessments if applicable.
BE IT FURTHER RESOLVED, That the Plan Commission recommend the
rezoning of the Chamberlain Hill property to the RSE I COPD Residential
Suburban Estate District with Conservation Planned Development District
Overlay.
8' BE IT FURTHER RESOLVED, That the inclusion of four residential parcels as
illustrated on the July 16, 2002 submittal is conditioned upon final determination
by the Common Council that at least three of the density bonus criteria of
Section 18:81(2) of the Land Division Ordinance have been met.
BE IT FURTHER RESOLVED, That the Plan Commission recommends private
ownership of Outlots 1, 2 and 3 by an incorporated Home Owners Association,
with all maintenance obligations depicted in a recorded Open Space
Management Plan.
BE IT FURTHER RESOLVED, That the final plat shall include easements as
required by the utilities of jurisdiction, and shall include 5 foot wide street tree
easements on both sides of all rights-of-way.
