RECOMMENDATION TO COMMON COUNCIL TO REZONE PROPERTIES WITHIN
THE GROUND WATER RECHARGE AREA AND PROTECTION ZONE OF THE
FREEDOM SQUARE CONDOMINIUM WELL #2 TO INCLUDE THE OWP OVERLAY
WELLHEAD PROTECTION DISTRICT LOCATED IN THE NE % OF SECTION 9 AND
NW %AND SW % OF SECTION 10
WHEREAS, The residents of the City of Muskego depend exclusively on groundwater
for a safe drinking water supply, and
WHEREAS, The Freedom Square Condominium Association has requested that the
City of Muskego Water Utility acquire their private water distribution system, and
WHEREAS, The Public Utilities Committee has recommended the acquisition to the
Common Council, and
WHEREAS, It is recognized that certain land use practices and activities can seriously
threaten or degrade groundwater quality, and
WHEREAS, Pursuant to Wisconsin Legislative Act 410 of 1984 and the requirements
of Wisconsin Administrative Code Section NR 811 16(5), Chapter 17:9.11 Overlay
Wellhead Protection (OWP) District is proposed to be established, and
WHEREAS, The intent of this overlay district is to protect the City of Muskego's
municipal water and well fields, and
WHEREAS, Upon the petition of the Public Utilities Committee, a public hearing has
been scheduled before the Common Council on July 9, 2002.
THEREFORE BE IT RESOLVED, That the Plan Commission does hereby recommend
approval to the Common Council the rezoning of properties within the groundwater
recharge area and protection zone of the Freedom Square Condominium Well #2 to
include the OWP Wellhead Protection Overlay District, located in the NE % of Section 9
and NW % and SW % of Section 10, specifically the following properties identified by
Tax Identification Number.
