PCR2002086RESOLUTION #PC 086-2002 APPROVAL OF A THREE (3) LOT LAND DIVISION FOR THE MACIOLEK PROPERTY LOCATED IN THE SW % OF SECTION 2 (PART OF TAX KEY NO. 2167.995.001) WHEREAS, On June 7, 2002 a Certified Survey Map was submitted by MRED Commercial for a two (2) lot land division of the Maciolek Limited Partnership property located in the SW % of Section 2, and WHEREAS, A revised Certified Survey Map was submitted on June 12,2002 illustrating the division of three (3) lots, and WHEREAS, The proposed land division would create lots with a minimum area of 35,489 square feet (0.81 acres) and an average minimum width in excess of 100 feet, and WHEREAS, Said properties are currently zoned RS-2, Suburban Residence District, and said lands are proposed to be rezoned to BS/OPD, General Business District. as modified by the Planned Development Overlay, to the north of the 60-foot right-of-way dedication and RSNOPD, Attached Single Family District as modified by the Planned Development Overlay, to the south of the right-of-way dedication as outlined in 0 Resolution # PC 088-2002, and said parcels meet the minimum zoning requirements for lot width and area, and WHEREAS, The 2010 Comprehensive Plan depicts this area as being set aside for commercial development and said lands are proposed to be included in a Plan amendment as outlined Resolution # PC 088-2002, and WHEREAS, Municipal sanitary sewer and water will serve the proposed parcels, and WHEREAS, All rights-of-way have been dedicated in accordance with the 2010 Street System Plan, and THEREFORE BE IT RESOLVED, That the Plan Commission approve of a Certified Survey Map being submitted creating a three (3) lot land division of the Maciolek property in the SW % of Section 2 subject to resolution of technical discrepancies as identified by the City Planning Department and City Engineers, and payment of all applicable fees in Section 18.14(3) of the Land Division Ordinance and outstanding assessments if applicable. BE IT FURTHER RESOLVED, That direct access to Janesville and Moorland Roads shall be prohibited, and said designation shall be illustrated on the Certified Survey Map. BE IT FURTHER RESOLVED, That required vision corners and street names shall be illustrated on the Certified Survey Map prior to Common Council review. BE IT FURTHER RESOLVED, That approval of this Resolution is subject to the approval of Resolution # PC 088-2002 amending the 2010 Comprehensive Plan from commercial development to medium-density residential development for the lands south of the right-of-way dedication. BE IT FURTHER RESOLVED, That approval of this Resolution is subject to the approval of Resolution # PC 088-2002 and the Common Council amending the Ofticial Zoning from RS-3, Suburban Residence District, to B-3/0PD. General Business District as modified by the Planned Development Overlay, and RSNOPD, Attached Single Family District as modified by the Planned Development Overlay.
