RECOMMENDATION TO COMMON COUNCIL TO REZONE PROPERTY ACQUIRED FOR
RS-3 - nlP /R-A - npn AND AMEND THE 2010 COMPREHENSIVE PLAN TO DEPICT
FREEDOM SQAURE STORMWATER POND EXPANSION FROM RS-2 / RSA B-4-OPD TO
INSTITUTIONAL USE OF THE NORTHERLY 500 FEET OF THE PARCEL LOCATED IN THE
NW % OF SECTION 10 (TAX KEY NO 2198.991)

WHEREAS, On June 5, 2002 a petition for rezoning and Comprehensive Plan amendment was
submitted by the City of Muskego Planning Department to rezone property in the NW % Of
Section 10. and
WHEREAS, the City acquired the parcel commonly referenced as Tax Key No. 2198.991 in order
to utilize the northerly 500 feet for stormwater management purposes, and
WHEREAS, the 2010 Comprehensive Plan depicts the northerly 500 feet of the parcel to be
developed for low density residential purposes, and
WHEREAS, The proposed use is permitted in residential areas, but said use is designed for
municipal purposes consistent with institutional designation, and
WHEREAS, The northerly 500 feet of the properly is zoned RS-2 Suburban Residence District
and RSA Attached Single Family Residence District, and
WHEREAS, The Planning Department proposes to rezone the northerly 500 feet of the property
to RS-2 /OIP Suburban Residence District with Institutional and Public Service Overlay District,
and
WHEREAS, The balance of the property is zoned 8-4 / OPD Highway Business District with
Planned Development Overlay District, and no zoning or Comprehensive Plan amendments are
proposed in this area, and
WHEREAS, A Public Hearing for the rezoning and Comprehensive Plan amendment has been
scheduled before the Common Council on July 9, 2002.
THEREFORE BE IT RESOLVED, That the Plan Commission recommends a Comprehensive
Key No. 2198.991 as being Government and Institutional Use.

BE IT FURTHER RESOLVED, That the Plan Commission recommends an amendment to the
Key No. 2198.991 as being zoned RS-2 / OIP
BE IT FURTHER RESOLVED, That the Plan Commission does hereby recommend approval to
the Common Council for the rezoning Suburban Residence District with Institutional and Public
Service Overlay District.
