PCR2002079ARESOLUTION #P.C. 079A-2002 APPROVAL OF A BUILDING SITE AND OPERATION PLAN FOR ALL-STAR RENTALS LOCATED ON THE STEINHAUS SUPPLY, INC. PROPERTY LOCATED IN THE NE % OF SECTION 34 (S107 W16262 LOOMIS DRIVE /TAX KEY NO. 2296.998.001) WHEREAS, Plans were submitted on May 24, 2002 by Mike Erickson d/b/a All-star Rentals, requesting approval of a Building Site and Operation Plan for equipment rental at the Steinhaus Supply, Inc. property located in the NE % of Section 34 (S107 W16262 Loomis Drive I Tax Key No. 2296.998.001), and WHEREAS, Revised plans were received on June 7, 2002. and WHEREAS, The property is zoned 8-4, Highway Business District, and the proposed use is permitted by right with an approved BSO Plan, and WHEREAS, The 2010 Comprehensive Plan depicts the property to be utilized for commercial purposes, and the proposal is consistent with the Plan, and WHEREAS, The Conservation Plan identifies the area as a high priority management initiative due to the designation of STH 36 as a view corridor, and WHEREAS, The property is subject to the provisions of the Muskeao Desian Guide, which has been duly adopted as a component of the 2010 Comprehensive Plan, and WHEREAS, The plans illustrate the installation of new asphalt paving for access and parking areas, and a paved display area, and WHEREAS, Parking for 19 vehicles are illustrated, with the future parking for 10 more available, and I WHEREAS, Paved areas for outdoor storage of equipment and trailers are indicated and the equipment view by the planting of arbor vitae, and will be contained within a 6-foot high dog-eared fence with a gate, and the trailers will be screened from WHEREAS, The plan indicates the planting sizes of evergreen material to be 4feekF min~~~m~f~reme~t-ls-6-feet at the time of planting, and heig&and-€heCity .~~E-PIS,FhefitP~~..~~Fates-acse ~has-cesem~~g~~6~~~~e~;~e-t.~.-.~s~i~~-~-.~~.i~i~y-t~~~-~ I WHEREAS, A landscaping plan has been submitted and -review& by the City Forester I for species compliance, and the plan indicates that the planting sizes meet the City requirements, and WHEREAS, No signage has been proposed for the property, and all proposed signage for the site will be required to be submitted to the Plan Commission for review and approval, and WHEREAS, The plan does not indicate if refuse containers will be located on the property. and all outdoor refuse containers must be kept within a screened enclosure, and WHEREAS, The total area of impervious surface proposed to be added to the site is less that 0.5 acres, and is therefore exempt from the provision of Chapter 34 of the Municipal Code. THEREFORE BE IT RESOLVED, That the Plan Commission approves of a Building Site and Operation Plan for All-star Rental on the Steinhaus Supply, Inc. property located in NE 'A of Section 34. I 0 @I .. BE IT FURTHER RESOLVED, A list of the equipment to be stored outside shall be provided to the Planning Department. tl .. BE IT FURTHER RESOLVED, That a copy of said plans be kept on file in the Building Department and that all aspect of this pian as they relate to landscape areas and drainage shall be maintained in perpetuity unless otherwise authorized by the Plan Commission. BE IT FURTHER RESOLVED, That if occupancy is requested prior to the completion of landscaping andlor second lift of asphalting, a cash bond, letter of credit, or cashiers check equal to twice the value of said costs must be submitted to the Planning Department. BE IT FURTHER RESOLVED, That failure to comply with the approval contained in this resolution shall result in the imposition of fines of $100 per day, the initiation of legal action, or both.
