APPROVAL OF A SKETCH PRELIMINARY PLAT FOR THE LAIMON
PROPERTY, LOCATED IN THE SE 1/4 OF SECTION 24
(TAX KEY NO. 2257.999)
WHEREAS, A sketch for a preliminary plat was submitted on April 9, 2002 by
Bob Stack on behalf of Tom Laimon for a property located in the SE 1/4 of
Section 24, Tax Key No. 2257.999, and
WHEREAS, Said plat proposes 17 lots, ranging from 15,000 square feet to
26,000 square feet in size, and
WHEREAS, Said property is zoned RS-3 Suburban Residence District, requiring
a minimum lot size of 15,000 square feet and an average minimum width of 100
feet, and said lots appear to meet said minimum zoning requirements, and
WHEREAS, The 2010 Comprehensive Plan depicts this area for medium density
residential development and the proposal is consistent with the Plan, and
WHEREAS, Said parcels will be serviced by City sewer and will access water
jurisdiction, and no new access points are proposed, and
WHEREAS, A 30 foot wide access control and landscape buffer strip is
illustrated abutting North Cape Road, and
WHEREAS, The 2010 Street System Plan depicts Ryan Road to be an 80-foot
ultimate right-of-way, and
WHEREAS, The plat is required to accommodate on-site stormwater
management as required by Chapter 34, and
WHEREAS, Chapter 18 requires remnant parcels of less than 20 acres to be
included on the Preliminary and Final plats, and
WHEREAS, A lot line adjustment with an abutting property is proposed.
a THEREFORE BE IT RESOLVED, That the Plan Commission approves of a 17
parcel sketch preliminary plat as submitted on April 9, 2002 for the Laimon
property located in the SE 114 of Section 24 and will be receptive to the submittal
of a preliminary plat.
0 BE IT FURTHER RESOLVED, That Outlots within the plat shall be owned and
maintained by an incorporated Home Owners Association.
BE IT FURTHER RESOLVED, That a Stormwater Management Plan shall be
prepared for the Outlots within the plat, and shall be executed concurrent with
the Final Plat.
BE IT FURTHER RESOLVED, That the remnant parcels shall be included within
the plat boundaries.
BE IT FURTHER RESOLVED, That the lot line adjustment with the abutting
property shall occur by metes and bounds description and transfer prior to
platting, or the abutting parcel shall be included within the plat boundary.
