APPROVAL OF A SKETCH CONSERVATION SUBDIVISION
FOR THE BLATTNER PROPERTY BY CREATIVE HOMES
LOCATED IN THE NW % OF SECTION 24
(TAX KEY NO. PART OF TAX KEY NO. 2253.999 / NORTH CAPE ROAD)
WHEREAS, On April 2, 2002 the Plan Commission approved a 16 parcel Yield
Plan for Creative Homes for the Blattner property located in the NW % of Section
24, and
WHEREAS, On March 28, 2002 a sketch for a 19 parcel, 2 outlot, Conservation
Subdivision was submitted by Creative Homes, and
WHEREAS, The sketch Conservation Subdivision provides for a common
stormwater management outlot and open spaces totaling approximately 46% of
the land area, and the COPD regulations would permit 16 residential parcels by
right, three (3) “bonus” parcels subject to meeting certain code provisions, and
requires a minimum of 50% open space, and
WHEREAS, Said property is zoned R-2 Country Home District, R-3 Country
Home District, and RS-2 Suburban Residence District, and a rezoning to RSE /
COPD Suburban Estate District with Conservation Planned Development
Overlay District would be required in order to implement the sketch preliminary
plat, and

WHEREAS, The 2010 Comprehensive Plan depicts this area for residential
development at a density not to exceed 0.5 to 0.7 dwelling units per acre, and
the Yield Plan illustrates a maximum density of 0.78 dwelling units per acre
under existing zoning, and
WHEREAS, Said parcels will be serviced by municipal sanitary sewer and
private water services, and
WHEREAS, The 2010 Street System Plan depicts Boxhorn Drive to have a 60
foot wide ultimate width, and the proposal is consistent with the Plan, and
WHEREAS, North Cape Road has been previously dedicated to its ultimate
width as depicted on the 2010 Street System Plan, and
a WHEREAS, Wetlands and woodlands which are remnant of Oak Savanna exist
on the property and are depicted on the sketch Conservation Subdivision to be
0 preserved as common open space, and the Conservation Plan depicts the
wetlands and woodlands as a high land acquisition priority, and
WHEREAS, The property drains to the east towards Dumke Lake, and the Plan
Commission acknowledge there are existing drainage problems associated with
this sub-basin, and
WHEREAS, The proposed sketch includes three (3) parcels with direct driveway
access to Boxhorn Drive, and said access points may be located in areas with
restricted sight lines, and
WHEREAS, The plat is required to provide on-site stormwater management as
required by Chapter 34, and the sketch Conservation Subdivision
accommodates this requirement.
THEREFORE BE IT RESOLVED, That the Plan Commission approves of a
sketch Conservation Subdivision for the Blattner property proposed by Creative
Homes, and located in the NW % of Section 24 and will be receptive to the
submittal of a preliminary plat of the Conservation Subdivision.
BE IT FURTHER RESOLVED, That the Conservation Subdivision shall have a
maximum of 16 parcels permitted by right, with an additional three (3) bonus
residential parcels permitted subject to Plan Commission and Common Council
findings that the Final Plat meets the requirements for the receipt of said bonus
parcels.

BE IT FURTHER RESOLVED, That the Conservation Subdivision shall have a
minimum of 50% open space in outlots, and petitioner shall provide area
calculations concurrent with Preliminary Plat submittal.
BE IT FURTHER RESOLVED, That the Plan Commission will be receptive to the
receipt of a rezoning petition to RSE / COPD Suburban Estate District with
Conservation Planned Development Overlay District, being a recommended
maximum residential parcel size of 20,000 square feet and a recommended
maximum average parcel width of 100 feet.
BE IT FURTHER RESOLVED, That prior to final approvals the developer shall
provide the City with engineering studies and remedies necessary to correct
existing drainage issues associated with the sub-basin.
BE IT FURTHER RESOLVED, That prior to final approvals the developer shall
provide the City with engineering studies and remedies necessary to provide
sight lines acceptable to the Public Works Committee for all parcels with direct
access to Boxhorn Drive. @
BE IT FURTHER RESOLVED, That the common open space areas shall be
subject to a Management Plan which shall be executed concurrent with the Final
Plat.
BE IT FURTHER RESOLVED, That a pedestrian way should be constructed
to connect the cul-de-sac with the preservation area.
BE IT FURTHER RESOLVED, That a right-of-way connection to the north is
required.
BE IT FURTHER RESOLVED, That Lots 1, 2, and 3 are reconfigured to
maintain a minimum lot size of 18,000 square feet.
