APPROVAL OF AN ANNUAL REVIEW FOR THE CONDITIONAL USE FOR A SALES AND
SERVICE ESTABLISHMENT FOR AUTOMOBILES FOR PIONEER AUTO AT THE PROPERTY
LOCATED IN THE SW X OF SECTION 9
WHEREAS, The Plan Commission approved a Conditional Use Grant amendment for sale of
automobiles at the property located at W179 57714 / 16 Pioneer Drive on May 15.2001. and
WHEREAS, The property is zoned 8-3, General Business District, and said use is allowed by
Conditional Use Grant, and the Plan Commission has required a annual review as a condition of
the approval, and
the front parking area, and
WHEREAS, Approved plans permit a maximum of eight (8) vehicles for sale to be displayed in
allow for vehicle disclosure information to be visible as required by State Law, and
WHEREAS, That signage and banners displayed on vehicles for sale is prohibited, except to
WHEREAS, The annual review has determined the property to be non-compliant for the following
issues:
1 Banners/flags were not previously approved by the Plan Commission.
2. Number of display vehicles exceeds the maximum allowed by the Conditional Use Grant,
and
THEREFORE BE IT RESOLVED, The Plan Commission approves of the petitioner's annual
review for Pioneer Auto, subject to compliance with all Conditional Use Grant conditions of
approval.
BE IT FURTHER RESOLVED, That the yearly review be held no later than the second meeting in
March of every calendar year,
BE IT FURTHER RESOLVED, That previously approved plans are kept on file in an address file
in the Building Department and all aspect of this plan shall be maintained in perpetuity unless
otherwise authorized by the Plan Commission.
BE IT FURTHER RESOLVED, Removal of all banners and flags shall occur within fifteen days of
the approval of this Resolution.
BE IT FURTHER RESOLVED, Removal of excess vehicles shall occur within fifteen days of the
approval of this Resolution.
BE IT FURTHER RESOLVED, That failure to comply with the approval contained in this
both.
resolution shall result in the imposition of fines of $100 per day, the initiation of legal action, or
