APPROVAL OF A FINAL PLAT FOR THE MARTIN ESTATES SUBDIVISION BY
MARTIN ESTATES LLC LOCATED IN THE SW1/4 OF SECTION 7
(TAX KEY NO 2187.999)
WHEREAS, On January 11. 2002 a final plat was submitted by Martin Estates LLC for
Martin Estates located in the SW % of Section 7, and
WHEREAS, Said plat consist of approximately 50.3 acres, and proposes 16 residential
parcels, ranging from approximately 44,000 square feet to approximately 60,000 square
feet in size, and two outlots. and
WHEREAS, Said property is zoned RCE Residential Country Estate District, and is
proposed to be rezoned to include the COPD Conservation Planned Development
Overlay District, and a public hearing has been held before the Common Council
regarding said rezoning, and
WHEREAS, The final plat proposes three residential parcels in addition to the base
density permitted by the RCE District, and said parcels may be permitted provided that
three of the eight criteria of Section 18.81(2) of the Land Division Ordinance are found
to be met, and
e WHEREAS, The Plan Commission finds that the petitioner has met four of the eight
criteria of Section 18.81(2) of the Land Division Ordinance, being:

access restriction along Field Drive, and said restriction is not depicted on the final plat,
WHEREAS, The Plan Commission's preliminary plat approval required a vehicular

WHEREAS, The Conservation Plan depicts the parcel as having medium priority Land

concurrent with the Final Plat pursuant to Plan Commission Resolution #PC 009-2002,
and
WHEREAS, The Plan Commission's preliminary plat approval required the submittal of
detailed Street Tree and Landscape Plans and said plans are reviewed concurrent with
the Final Plat pursuant to Plan Commission Resolution #PC 010-2002, and
WHEREAS, The 2001-2005 Park and Open Space Plan does not identify any land
acquisitions in the area, and
WHEREAS, The Plan Commission's preliminary plat approval required the illustration of
all utility easements on the final plat, and no easements are depicted for natural gas,
electric, telephone, or cable utilities, or other utilities of jurisdiction.
a THEREFORE BE IT RESOLVED, That the Plan Commission recommends approval to
the Common Council of a 50.3 acre, 16 parcel, 2 outlot, final plat for Martin Estates
Subdivision by Martin Estates LLC located in the SW 'A of Section 7, subject to
resolution of technical discrepancies as identified by the City Planning Department and
City Engineers, and payment of all applicable fees in Section 18.14 of the Land Division
Ordinance and outstanding assessments if applicable.
BE IT FURTHER RESOLVED, That prior to execution by City Officials, the final
plat shall depict a vehicular access restriction to Field Drive from Outlot 1 and
Outlot 2.
BE IT FURTHER RESOLVED, That prior to execution by City Officials, the final
plat shall include easements as required by the utilities of jurisdiction, and shall
include 10 foot wide street tree easements on both sides of all rights-of-way.
