PCR2002009e APPROVAL OF A CONSERVATION EASEMENT AND OPEN SPACE MANAGEMENT PLAN RESOLUTION #PC. 009-2002 FOR THE MARTIN ESTATES SUBDIVISION LOCATED IN THE SW X OF SECTION 7 (FIELD DRIVE / TAX KEY NO. 2187.999) WHEREAS, A Conservation Easement and Open Space Management Plan were submitted by the City of Muskego Conservation Coordinator for the Martin Estates Subdivision located in the SW X of Section 7, and WHEREAS, The Conservation Easement provides that Outlot 1 and Outlot 2 shall be retained in permanent open space uses, and WHEREAS, Said Easement is based on national models promoted by the Trust for Public Land and the Land Trust Alliance, and the form has been approved by the City Attorney. and WHEREAS, The Open Space Management Plan has been drafted for Outlot 1 and Outlot 2 and provides short term and long term land management guidelines for the developer and the incorporated Owners Association. WHEREAS, The documents provide for the establishment of a maintenance account with the City of Muskego, to be capitalized by the developer and maintained by the Owners Association, to be used for any City expenses associated with implementing the land management practices. THEREFORE BE IT RESOLVED, That the Plan Commission approves of the Conservation X of Section 7 Easement and Open Space Management Plan for the Martin Estates Subdivision located in the SW BE IT FURTHER RESOLVED, That a copy of said Easement and Plan shall be kept on file in the Planning Department and that all aspect of this plan as they relate to land management shall be maintained in perpetuity unless otherwise authorized by the Common Council, or their successors and assigns to the Easement. shall result in the imposition of fines of $100 per day, the initiation of legal action, or both.
