PCR2001173RESOLUTION #P.C. 173-2001 DETERMINATION OF USE AND APPROVAL OF A BUILDING SITE AND OPERATION PLAN FOR ALUMINIUM RECYCLING OPERATIONS FOR MERCURY MUSKEGO. LLC ON THE PROPERTY ~~ ~ ~~ ~ LOCATED AT W188S8393 MERCURY DRIVE IN THE SW OF SECTION 17 (TAX KEY NO. 2228.999.007) ~ ~~ ~~ ~ WHEREAS, A letter was submitted on October 18. 2001 by Attorney Timothy Randall representing Mercury Muskego, LLC for a Building, Site and Operation Plan for aluminum recycling operations on the property at W188 58393 Mercury Drive, formerly known as The Delta Group (Tax Key No. 2228.999.007), and WHEREAS, Said property is currently zoned 1-1. Industrial Park District, and as said use is not identified as a permitted or conditional use, and WHEREAS, Per Chapter 17:5.01(3) the Plan Commission shall make a determination of use where the proposed use is not specifically listed in the Zoning Code, and WHEREAS, Building Site and Operation Plans are required to be submitted for review, and said plans have not been submitted at this time, and WHEREAS, The operations propose bulk aluminum recycling, consisting of material separation only, and no material or product melting of any kind will occur on the site, and WHEREAS, The operations will occur on Monday through Saturday, with no Sunday or holiday operations, and WHEREAS, All materials will be contained within the existing building and no product or materials will be stored outdoors, and WHEREAS, The petitioner indicates that there will be four (4) on-site employees THEREFORE BE IT RESOLVED, That the Plan Commission approves of a Building, Site and Operation operations on the property at W188 S8393 Mercury Drive. Plan submitted by Attorney Timothy Randall representing Mercury Muskego. LLC for aluminum recycling BE IT FURTHER RESOLVED, That a copy of said plans be kept on file in the Building Department and that all aspects of this plan as they relate to landscape areas and drainage shall be maintained in perpetuity unless otherwise authorized by the Plan Commission. BE IT FURTHER RESOLVED, That if occupancy is requested prior to the completion of landscaping andlor asphalting, a bond, letter of credit or cashiers check equal to twice the value of said costs must be submitted to the Planning Department. BE IT FURTHER RESOLVED, That failure to comply with the approval contained in this resolution shall result in the imposition of fines of $100 per day, the initiation of legal action, or both.
