APPROVAL OF A TWO LOT LAND DIVISION FOR THE WHITEHOUSE
PROPERTY LOCATED IN THE NW % OF SECTION 7
(TAX KEY NO. 2186.991 / W218 S7368 CROWBAR ROAD)
WHEREAS, A Certified Survey Map was submitted by Ken Whitehouse for a two (2) lot land
division of the Whitehouse property located in the NW % of Section 7, (Tax Key No. 2186.991 I
W219 S7368 Crowbar Road), and
WHEREAS, Said property is zoned RCE Residential Country Estate, requiring a minimum lot
size of 2.75 acres and an average minimum width of 250 feet, and the proposal conforms to
these requirements, and
WHEREAS, The adopted Comprehensive Plan depicts this area as being set aside for low
density residential development, and this proposal is within this goal, and
WHEREAS, Said parcels will not be serviced by City sewer and water, and
WHEREAS, A private well exists on parcel land serves parcel 2, and said well and plumbing
must be placed within an easement, or the connections should be terminated and new private
water service provided to parcel 2, and
WHEREAS, The 2010 Street System Plan depicts Crowbar Road to have an 80' ultimate right
of way width, and is required to be illustrated on the final CSM.
WHEREAS, An existing WEPCO easement traverses the east property boundary, and is
required to be illustrated on the final CSM.
WHEREAS, Outbuildings exist on parcel one which conform to the size requirements of the
municipal code, which are legal non-conforming due to street yard setback, and which require
a principal structure to be constructed or said outbuildings must be removed, and
WHEREAS, Outbuildings exist on parcel two which conform to the size requirements of the
municipal code and which are legal and conforming, and
WHEREAS, Existing driveways cross the side lot lines, and said driveways must be terminated
with three (3) foot side yards provided, or a shared driveway easement must be provided on
the CSM.

THEREFORE BE IT RESOLVED, That the Plan Commission approves of a Certified Survey
Map being submitted creating a two (2) lot land division of the Whitehouse property in the NW
% of Section 7
BE IT FURTHER RESOLVED, That the Plan Commission determines that the accessory
structures on Parcel 1. shall be razed within one year of the recording of this CSM unless with
said year, a building permit is issued for a permitted principal structure, and this requirements
shall be illustrated on the CSM.
BE IT FURTHER RESOLVED, That grading and drainage plans will be required to be
approved by the City Engineer concurrent with an application for building permits.
BE IT FURTHER RESOLVED, That a digital '.DXF tile, *.DGN tile, or '.DWG tile of this final
plat be submitted to the City prior to City signatures being placed upon the CSM (3-1/2"
diskette) and all information transmitted on the diskettes shall be tied to and referenced to
State Plane Coordinates NGVD 1929 or others approved by the City Engineer,
