APPROVAL OF AN AMENDMENT TO THE BUILDING SITE AND OPERATION PLAN
AND CONDITIONAL USE GRANT FOR PAWS INN AT THE PROPERTY LOCATED AT
S92 W19918 HENNEBERRY DRIVE (TAX KEY NO. 2239.999)
WHEREAS, On April 15, 1980 the Plan Commission granted a Conditional Use permit for the
property located at S92 W19918 Henneberry Drive, to Lee Shane. for the operation of a
commercial dog kennel, and
WHEREAS, An approval of expansion of the Conditional Use Grant #81 was approved July 15.
1986. to permit an expansion of the number of dogs from twenty (20) to no more than fifly (50).
and
WHEREAS, On August 23, 2001, plans were submitted by Sandra Peterson for a conceptual
Conditional Use Grant for commercial dog kennel located on the property at S92 W19918
Building, Site and Operation Plan amendment and determination of a substantial change to a
Henneberry Drive, and
WHEREAS, Annual review by the Plan Commission was a condition of approval, and one year
extensions have been granted since that time, and
WHEREAS, The Plan Commission determined the proposal to be a substantial change to the
#PC 137-2001, and a public hearing is required, and
previously approved Building Site and Operation Plan and Conditional Use Grant in Resolution
WHEREAS, A public hearing was scheduled for October 16. 2001 before the Plan Commission,
and
WHEREAS, A 22' by 38' building expansion is proposed for the east wing of the kennel structure,
said expansion would include 16 outdoor runs, and
WHEREAS, The materials will be architectural block to match the existing structure, a gabled roof
will be installed over the entire wing, and the entire structure will be insulated and have acoustic
tiles installed, and
WHEREAS, The existing gravel drive and parking area will be paved with asphalt, and
WHEREAS, The petitioner is requesting to increase the number of dogs from fifty (50) to one-
hundred (loo), and the Plan Commission must determine if the request represents a substantial
change to the previously approved conditional use grant, and
WHEREAS, All conditions have been complied with and no complaints have been registered
during the past year.
THEREFORE BE IT RESOLVED, That the Plan Commission approves of a Building, Site and
Operation Plan and Conditional Use Grant amendment allowing the boarding of one hundred
(100) dogs in the commercial dog kennel located on the property at S92 W19918 Henneberry
Drive.
BE IT FURTHER RESOLVED, The Director of Building and Engineering will need to determine if
additional stormwater management measures are required.

BE IT FURTHER RESOLVED, That a yearly review be held no later than the second meeting in

BE IT FURTHER RESOLVED, That a copy of said plans be kept on file in the Building
Department and that all aspects of this plan as they relate to landscape areas and
drainage shall be maintained in perpetuity unless otherwise authorized by the Plan
Commission.
BE IT FURTHER RESOLVED, That if occupancy is requested prior to the completion of
landscaping andlor asphalting, a bond, letter of credit or cashiers check equal to twice
the value of said costs must be submitted to the Planning Department.
BE IT FURTHER RESOLVED, That failure to comply with the approval contained in this
resolution shall result in the imposition of fines of $100 per day, the initiation of legal
action. or both.
