RECOMMENDATION OF APPROVAL OF A PRELIMINARY PLAT FOR THE
MARTIN ESTATES SUBDIVISION BY REALCAP LLC LOCATED IN THE
SW1/4 OF SECTION 7 (TAX KEY NO 2187.999) a
WHEREAS, On September 21, 2001 a preliminary plat was submitted by
RealCap LLC for Martin Estates located in the SW '/4 of Section 7, and
WHEREAS, Said plat consist of approximately 50.3 acres, and proposes 16
residential parcels, ranging from approximately 44,000 square feet to
approximately 60,000 square feet in size, and one outlot, and
WHEREAS, Said property is zoned RCE Residential Country Estate District, and
is proposed to be rezoned to include the COPD Conservation Planned
Development Overlay District, and
WHEREAS, The Plan Commission has previously approved a 13 parcel sketch
land division, which satisfies the requirement for a Yield Plan, and
WHEREAS, The preliminary plat proposes three residential parcels in addition to
the base density permitted by the RCE District, and said parcels may be
permitted provided that three of the eight criteria of Section 18.81 (2) of the Land
Division Ordinance are found to be met, and
WHEREAS, The 2010 Comprehensive Plan depicts this area for rural density
residential development, and
WHEREAS, Said parcels will be serviced by private sanitary sewer and water
facilities, and
WHEREAS, The 2010 Street System Plan depicts Field Drive to have an 80 foot
wide ultimate right-of way, and the appropriate dedications are illustrated, and
WHEREAS, Public right-of-way reservations have been extended to the east plat
line, and
WHEREAS, Wetlands, woodlands, and steep slopes are present on the subject
parcel, and a Detailed Site Analysis has been provided, and
WHEREAS, The DRAFT Conservation Plan depicts the parcel as having
medium priority Land Management objectives, and a Management Plan for
Outlot 1 will be required concurrent with the Final Plat, and
WHEREAS, The 2001-2005 Park and Open Space Plan does not identify any
land acquisitions in the area, and
0 THEREFORE BE IT RESOLVED, That the Plan Commission recommends approval to the Common Council of a 50.3 acre, 16 parcel, 1 outlot, preliminary
plat for Martin Estates Subdivision by RealCap LLC located in the SW % of
Section 7 and will be receptive to the submittal of a final plat, subject to
resolution of technical discrepancies as identified by the City Planning
Department and City Engineers, and payment of all applicable fees in Section
18.14 of the Land Division Ordinance and outstanding assessments if applicable.
BE IT FURTHER RESOLVED, That the inclusion of three residential parcels as
illustrated on the September 21, 2001 submittal is conditioned upon final
determination by the Common Council that at least three of the density bonus
criteria of Section 18:81(2) of the Land Division Ordinance have been met.
BE IT FURTHER RESOLVED, That concurrent with final plat review, the Plan
Commission shall be receptive to a rezoning petition to the RCE I COPD
Residential Country Estate District with Conservation Planned Development
District Overlay.
BE IT FURTHER RESOLVED, That the Plan Commission recommends private
ownership of Outlot 1, by an incorporated home owners association. e BE IT FURTHER RESOLVED, That the Plan Commission recommends the
development of conservation management plans for Outlots 1 concurrent with
final plat submittal.
BE IT FURTHER RESOLVED, That all wetlands are to be properly identified on
the face of the final plat, and the final plat shall include text describing wetland
regulations.
BE IT FURTHER RESOLVED, That the final plat shall include easements as
required by the utilities of jurisdiction, and shall include 5 foot wide street tree
easements on both sides of all rights-of-way.
