PCR2001153RESOLUTION #P.C. 153-2001 APPROVAL OF AN ACCESSORY STRUCTURE FOR THE YETS PROPERTY LOCATED AT W186 59611 PARKER DRIVE (TAX KEY NO. 2270.995.003) WHEREAS, On September 20, 2001 a site plan and construction information was submitted by James Yets to construct a 2,100 square foot accessory structure at the property located at W186 S9611 Parker Drive, and WHEREAS, The property is zoned R-1, Country Home District, and where said structure is a permitted accessory use and subject to Plan Commission review per Section 4.05 (2) C.l. and WHEREAS, The total square footage for accessory structures is limited to 1 -percent of the land area and said area contains 3.75 acres which would allow 1,632 square feet of total square footage of accessory buildings, and WHEREAS, One outbuilding currently exists on the parcel totaling approximately 80 square feet, and the Plan Commission may allow exceptions to the 1 -percent requirement in "Predominantly undeveloped areas." and WHEREAS, The location of the structure meets the required setback and offsets, the ultimate height is limited to 25 feet, the architectural appearance would be compatible with the applicant's surrounding area, and the materials submitted do not propose the use of this nor any other structure on the property for business related activities, and WHEREAS, The structure will be constructed with cedar lao sidina and a shinaled roof, and the ~ materials and colors will match the existing residence. THEREFORE BE IT RESOLVED, That the Plan Commission finds that the Darcel meets the - criteria for a predominantly undeveloped area allowing for an exception to the 1 -percent 2,100 square feet for the Yets property at W186 S9611 Parker Drive in accordance to Section requirement for accessory structures and approves of a compatible size structure not exceeding 4.05 (1) B and 6.1 1 (2). BE IT FURTHER RESOLVED, That failure to comply with the terms of this resolution and the approved site plans shall result in the issuance of fines of $100 per day per violation, the initiation of legal action, or both.
